Poor, Dissappoint and Rude Service from VW Bryanston

Good day

I am emailing with a hope that I can get someone who can assist me regarding the poor, rude and disappointing service that I have been receiving from VW Bryanston. In 2015, February I bought a brand new Polo 1.2 TSI from VW Bryanston. In 2015 I brought a brand new VW 1.2 Polo GP TSI within 2 months of having ownership of the car the car started giving me issues

The gear lever was getting stuck on gear number one
While changing the gear I would get a clattering sound coming underneath the car

Road side assistance was called numerous times to come and assist and their diagnosis was a factory faulty which caused my bolts to loosen while driving. I was advise to take my car in to a dealership for further fixing, so I took it to VW Hatfield Bryanston where I had bought the car from. The first time I took it they were able to fix the gear lever but failed to fix the issues with the bolts, the technician that I dealt with at the time confirmed that the issue was a factory fault, after 4 attempts I decided I had had enough and so I asked the dealer to replace the car as they were clearly failing to fix the issues. I made this request based on the consumer protection act which state that every product must carry a warranty of at least six months. The consumer may return goods to the supplier if it does not comply with the requirements of this section. The consumer may return the goods: Within six months. Without paying a penalty fee. At the risk of the supplier. Unfortunately the principal dealer Cheryl Claasens decided to send rude email accusing me of being the one that keeps breaking my own car. Our conversation escalated when we eventually met face to face the altercation nearly became physical with Cheryl threatening to call my employer and get me fired if I did not stop my “nonsense” as she put it and that there was no way that she was replacing my car. She practically chased me out of her office while referring to me as a Rude Black girl. I decided to leave and let my lawyers handle this but as I got into my car I then realised that the technician that had worked on my car had left some of my bolts inside the car without *****ing them back. When I went inside Cheryl started shouting again I then approach Brilliant the sales person who I had bought the car from and showed him the *****s. Then all of a sudden her attitude changed and she became cooperative. Eventually after about a week or 2 the car was exchanged.

But within few weeks of receiving the new car I then got a letter from VW SA informing me of a factory fault that had been reported on backrest frames of the front seat. I took my car to again VW Bryanston but they refused to fix the issue without giving a reason. On the 15 000 service I asked them to look at the seats as they were giving a squeaky sound when I drove the car but again this was not done. At 30 000 KMs they eventually did it, which left my car full of grease all over the inside (as per attached pictures). And left my air-conditioning system malfunction and now I was told I have to wait a minimum of 2 months for the new parts as it will come from Germany. On top of that I notice that the steering wheel was vibrating violently every time I app**** brakes. The technician Albert told me that this is because my disc plates are worn off and I need to pay R 3 500 to have then replaced. On the 16th of March my car was towed by road side assistance to VW Bryanston to get my brake discs replaced but the whole day my car set there with no one attending to it. Eventually I picked it up at 15h00 only to find that no technician was assigned to my car and I was told I need to bring it back on the 19th of April in order to be fixed. When I asked while they would be worn off so quickly Nigel Legge the Service Manager told me that it because I drive my car when it rains and basically I should drive when it rains and that when I take it to the car wash I should ask them not to wash the wheels of my car as it creates wear and tear. When I bought my car I was never told that I should not drive this car in the rain, neither was I told that I should not wash the wheels. But all of a sudden this is the excuse that the dealer puts forward. I have never had of any car brand where driving is the rain is prohibited.

Currently the issues with the car are:

Malfunction air-conditioning system
When I change gears there is a sound that comes underneath my car
The sound of the passenger and drivers seats
Grease that is all over my car
Brake pads that are not working properly and I have been told I need to pay R 3 500 in order for them to fix it and this can only be done on the 18th of April.
