Vodacom's refusal to Maintain infrastructure as required by the Consumer Protection Act (CPA)

I live in a area where Vodacom refuses to maintain their infrastructure, we have serious issues with lack of service and Mobile Data in the area. this issue has been in contention with Vodacom for over 3 years now. Vodacom has put it on record that the issue is due to the Hardware in the tower being outdated and secondly due to the tower being overloaded. Now surely Vodacom has a "Duty to Maintain" when it comes to the infrastructure, they have to insure stable and reliable service to the paying customers. I refer you to the following Sections in the Consumer Protection Act - Section 54 of the Consumer Protection Act deals with the imp**** warranty of quality for services. According to this section, consumers have the right to receive services that are: Of good quality: Services provided by Vodacom (or any other supplier) must meet a certain level of quality. If infrastructure is allowed to degrade and this leads to service interruptions or degradation, consumers could argue that Vodacom is not meeting the minimum quality standards. Fit for the purpose: The service must be fit for the purpose for which it is commonly used, i.e., Vodacom must maintain a reliable telecommunications service. Reasonably durable: Services must last for a reasonable period. If Vodacom allows infrastructure to fall into disrepair and customers lose service, this could be seen as a failure to ensure that the service lasts for an expected or reasonable duration. - Section 55 of the CPA requires that when services are provided, they must be: Rendered with reasonable care and skill: Vodacom must ensure that its infrastructure is maintained in a way that it can provide reliable service to consumers. If the network is allowed to degrade due to neglect or a failure to properly maintain equipment and infrastructure, it could be considered a violation of this duty. As described: The services must match the description provided to consumers (e.g., the coverage, reliability, and quality of the service promised). If Vodacom fails to maintain the necessary infrastructure to meet these expectations, this could be seen as a breach of the terms of service. - Section 56 of the CPA, consumers have the right to return a service if it is defective. This applies to the services provided by Vodacom: If there is a failure in the service, such as a loss of connectivity or coverage due to degraded infrastructure, consumers could argue that the service is defective. In such cases, the consumer may be entitled to demand a repair, a refund, or even a replacement service depending on the nature of the defect.

Vodacom’s Continued failure to maintain their infrastructure and provide a stable and reliable service to their customers is a blatant disregard of the Consumer Protection Act (CPA)

And yet again, its another month with no Joy from Vodacom. They sent me a message telling me they would supply a booster, I filled in the forms and nothing, not a word. Not even a reply to the questions I had. The Guy (Andrew) that contacted me and said he will provide me details is also just ignoring all communications.

This seems to be Vodacom's modus operandi, Just feed the customer empty promises and then disappear completely. Its very strange how a big company like Vodacom can operate in direct contradiction to the Consumer Protection Act, yet they keep getting all the licenses renewed. I think it is now time that i take this issue further and Lay an official complaint to the National Consumer Commission (NCC) with all the records and conversations I have had with Vodacom where they admit that they are not maintaining the infrastructure.

This issue has been going on for 6 months already and there is absolutely nothing Vodacom has done to rectify it. And other members in the community have had the same issue since 2020 with the exact excuse from Vodacom.

No One Made me aware of that, i have messaged Andrew on multiple occasions and he does not respond, i also asked questions regarding the type of booster and the installation process and nothing, no response.
