Vodacom sms spam and their inability to deal with the problem

<p>Since signing up on a new business contract. Vodacom has been sending me sms spam messages.</p> <p> </p> <p>"Enjoy exclusive rewards for being a loyal Vodacom business c ustomer. Click here [link] for this month's rewards. T&C apply"</p> <p> </p> <p>No opt out feature provided.</p> <p> </p> <p>At some stage, I did manage to opt out. Then received the following messages for two months:</p> <p> </p> <p>"Dear customer, we've missed telling you about the latest vodacom news & offers. Our records show that you are missing out on special offers and FREEbies. If you would like to opt in to marketing, reply START to 31118"</p> <p> </p> <p>Never did I reply to the message. Received two of those for the month.</p> <p> </p> <p>The next month, vodacom merely started sending me the same marketing SMS's I supposedly opted out of, and never opted back in for.</p> <p> </p> <p>I have logged more than 8 calls with vodacom on the issue. Promised to fix my issue. Even telling me I have been "unsubscribed".</p> <p> </p> <p>But I keep receiving the messages.</p> <p> </p> <p>Sent them the ISPA template, informing them of the laws that govern SMS spam. The template of which can be found here: http://www.internet.org.za/spam_message.txt</p> <p> </p> <p>To this day, over a period of a couple of months, vodacom has not resolved my issue.</p> <p> </p> <p>Based on them sending spam messages, without being able to opt out, can I proceed with a legal route?</p>
