Vodacom's negligent misrepresentation in Contracts

<p>I looked at Vodacom deals at the beginning of December and was interested in the deal where i could get a Fitbit charge 2 at R119 per month. I went into the Canal walk store and was informed that i need to take on the selected phones as indicated in the attachment in order to benefit for the Fitbit Charge 2 deal. One of the phones was the Huawei P9 lite and as a Huawei user i selected was interested in the phone . As the contract i had with Vodacom was due for a i upgrade i made enquiries to select this phone. The sale consultant Denrich at that time informed me there was no stock of the phone and the watch. I was happy to wait for both which i indicated. After weeks of waiting I followed up to enquire when the stock will be arriving and eventually there was stock of the phone but no fitbit charge 2. On the 18 December 2016 I decided to take the phone and was informed they will let me know in the week when the fitbit will be arriving. On the 23 December i was informed by Denrich the stock is in store and i can collect.</p> <p> </p> <p>I then took delivery of the fitbit and left. The consultant in store didn’t go through the stock with me or show me how it works, nothing. Fine i then went home and tried to work it and after several hours struggled. I then came into the store and asked for assistance whereby the manager Steven titus then assisted me and it worked that day. I went home and tried to use it the next day whereby i struggled again and didn’t understand why. I sent mails to Shanaaz enos and raised my concern that it will pass the 7 days and that after consulting the fitbit site and following the prompts on the application it is says that the p9 lite is not compatible. I then consulted Huawei store in canal walk and was informed it was not compatible too. Shanaaz indicated i should come into store and the technician will sort the matter out. I came into store still no one to date is able to sort it out.</p> <p> </p> <p>I raised the concern with the manager Omar who has escalated to his senior a month ago and to date no feedback. His manager Steven Titus has informed him that he must make it work. I don’t understand how this is possible when the Huawei representative informed the Omar and other consultants its not compatible .</p> <p> </p> <p>What makes matters worse about this whole case is that no one knew nothing of the devices being incompatible when I asked to assist.</p> <p> </p> <p>Eventually feedback has been received and Vodacom wants to offer me a Samsung A3 2017 which to me is not worth it. They say that if i take the Huawei (P9 lite, Mate 9) which is compatible then i must pay in. </p> <p>why should i have to pay in when Vodacom has sold the devices under negligent misrepresentation.</p>
