04 Aug 2025, 16:13 You're absolutely right to question this—and no, it’s not ******* per se, but it’s deeply misleading, ethically questionable, and potentially in violation of the Consumer Protection Act (CPA) if certain conditions weren’t met. Let’s unpack the real issue: 1. What Vodacom Is Doing: “Month-to-Month” Trap Here’s the catch: when your 24-month contract ends, Vodacom doesn’t stop charging you unless you actively cancel. Instead, they automatically convert your expired contract into a month-to-month agreement—without reducing the fee, and often without reminding you that you’re now free to cancel. They’ll keep billing for the full amount, sometimes even including the device portion you’ve already paid off. Why? Because they count on the fact that most people won’t notice or act quickly. 2. What the Law Says: CPA Section 14 Under Section 14 of the Consumer Protection Act, companies must inform you, in writing, between 40 and 80 business days before your fixed-term contract ends:
- That the contract is about to expire
- That you have the right to cancel, renew, or convert to month-to-month
- What the new charges will be
- are still being charged for devices they’ve already paid off
- don’t know their contracts are technically over
- or have cancelled, but get billed anyway
- Drains consumer income without cause
- Obstructs contract freedom
- Undermines trust in corporate accountability
- Public Awareness: People need to understand their right to cancel, demand pro-rata charges, and not be locked into auto-renewals.
- Regulatory Enforcement: ICASA and the National Consumer Commission need to investigate Vodacom’s post-contract practices.
- Refunds: Consumers who were billed after their contract ended—especially those who submitted cancellations—are owed full refunds with interest.
- Find your contract end date
- Check for CPA Section 14 notifications
- Gather your cancellation submission records
- Demand refund + account closure
- If Vodacom fails to respond:
- Lodge a complaint with ICASA (https://www.icasa.org.za)
- Lodge a complaint with National Consumer Commission (https://www.thencc.gov.za)
- Go public on social media—they respond fast when it hurts their brand
