Vodacom not complying with consumer protection act

Vodacom is refusing replace a defective device I bought from them last month. When I took the device to Vodacom4U where I bought the device to get the device replaced they insisted I had to take to Vodacom Customer repairs. At Vodacom customer repairs they insisted I had to book the device in for an assessment as they cannot just replace the device.

Two days later they said that the device was ready and that it wss only a software issue so I was not eligible for a replacement. When I checked the device I saw that it still had the same problems and when I asked for a replacement they refused saying that it has to be sent once again for an assessment as to whether or not I qualify for a replacement.

So once again I booked in the device. A few days later they told me the device was ready and when I asked them what they did to the device ans whether they had replaced they said no they repaired what was wrong with the device by replacing parts. I told them that I did not want the device repaired and that I wanted it replaced they said I had to take the matter up further. The device is still broken.

I tried to escalate the matter however everyone I speak says that they cannot help me and that I have to book it in again.

I tried to inform Vodacom that according to the Consumer Protection Act I am allowed to return a product that is defective within 6 months of buying it and that I am entiled to a replacement, refund or repair and that I cannot be forced to have the repair. It seems that Vodacom does tell their empolyees this as no-one actually knew that this was the law and insisted that Vodacom can only replace the device if is within 7 days.

Vodacom has violated the Consumer Protection Act.
