Vodacom increased the Smart S+ packages between 30-60%; without consultation.

Vodacom increased the Smart S+ packages between 30-60%; without consultation nor proper announcements; just via an SMS which warns you if you go into the webesite provides that your mobile date are at risk. For me it is a warning that it is a **** or hoax.

The only changes that Vodacom announce was the VAT increase effective date 1 April 2018. Which we all new about.

I did log a complaint with Vodacom on the 26/07/2018 after several phone calls I got a SMS this morning that the problem is resolved, without any consultation nor explanation how the problem was resolved. 1. Vodacom increased the Smart S+ packages between 30-60% and gave only 150MG as compensation; 2. They did not contacted nor consulted with me to find out I I can afford it; 3. The increase means I have to save a tank of fuel a month to be able to pay Vodacom, driving 200km a day it is nearly impossible; in other words coming to work is getting difficult.

I phoned them again this morning 6 Aug 2018 and their response was: 1. cancel the contract and pay a cancellation fee or 2. down grade on the package; 3. or wait until the 23rd August 2018 to see whats going to happen........

I am with Vodacom for 10 year and you take out a package that suits your pocket and for assistance on the road so that you do not run out of airtime. Now you have to downgrade it. My packages don't even include the instruments.

This is the poorest, most nonchalance service I ever received from Vodacom.

Can you please advise the way forward? Your assistance would be appreciated. 06 August 2018

Vodacom did come back with the following: Cellphone users must take not of the following, when engaging to your next cellphone contract. 1. The contract that cellphone users think they sign is not according the impression created by the outlet's representatives. - it is a one way contract and you as the customer DON'T HAVE ANY leverage or legal assurance covered in the contract what so ever, unless you can take them to court to changes the one side contract and their representative know-ling withholding real Terms and Conditions (past cases - Steyn v LSA Motors Ltd 1994 (1) SA 49 (A); Du Toit v Atkinson's Motors Bpk 1985 (2) SA 893 (A); Spindrifter (Pty) Ltd v Lester Donovan (Pty) Ltd 1986 (1) SA 303 (A)) Misrepresentation by silence due non disclosure Absa Bank Ltd v Fouche 2003 (1) SA 176 (SCA). 2. According to the outlet representatives and I tested it again on 26 August 2018 at SantonCity mall - they all had it - contract rates are fixed for 24 months and it will not change. Upon asking them about the clause 5.8 of the T&C they had no idea it exist. 3. Clearly the cellphone providers do not educate their representatives their T&C and that the contract rates are not fixed for 24 months, the contract is a one way contract - enabling the cellphone providers to change the rates at any given time at any % as they which. 4. Or they are taught to - deliberately withhold this information, which according to the Contract Law is *******; it brings the cellphone user under a false impression. "clause 5.8 The changes levied by Vodacom may vary from time to time.... You shall be bound to pay such varied changes.......unless you exercise your right of termination......... " 5. The right of termination will cost you 75% of the outstanding duration of the contract; 6. or switch to another lower package - which will cost you anything between R 1200 to R1600 depending on the package you choose.
