VODACOM I AM FINISHED WITH YOU AFTER THIS CONTRACT.

Hi Vodacom,

I would like to formally lay a complaint against the two staff members and store in Clearwater Mall (excessively rude and have the worst aftersales I have seen in my life) and then they have a wonderful loophole in the contract I advise anyone to be cautious as once you’ve signed the papers there is literally no way out, in fact once you touch the device you are ACKNOWLEGDE that you know the intimate details of the device, you ACKNOWLEDGE that you accept the terms and conditions straight away in the sense of you read up, broadened your knowledge of the device and are sure you know what you are purchasing even if that is not the case and you are taking someone else’s word.

1. Vivian (sales representative) – did not disclose surname 2. Ivan (Manager) – did not disclose surname

I was at the store Saturday the 8th of October as I was looking for a new cellular device but I wasn’t certain whether I would be doing a cash deal or a contract deal as my wife’s contract was coming to an end and had one month left before it was finished.

I then was approached by a sales representative.

3. Lebo (did not disclose surname)

And he presented me with the option of getting the Oppo Reno 5G Pro, it should be noted at this point in time I was still uncertain about contract or cash deal as the contract on my wife’s number was ending in November, and I was going to get some additional finances to be able to purchase a cellular device, hence the I wasn’t certain about doing a cash deal or a contract extension as I clearly don’t want to be in a long term relationship again, taking into consideration I have been a Vodacom client for over 10 +- years and have been loyal to Vodacom and I have been loyal to Samsung as we are a Samsung family and have been supporting Samsung our entire lives. The sales representative of Oppo then approached me and told me that the best device possible compared to Samsung would be the Oppo Reno 5G Pro, and I was very hesitant and very uncertain as I’ve never heard of this name nor brand in my existence and I have not done any research on the device itself.

He simply told me he guarantees that this device is better than any Samsung available in the store, and I reconfirmed this exact same question multiple times as I’ve said I am Samsung and have always would be. They eventually convinced me to take the contract with the Oppo Reno 5G Pro and after using it I can with all honesty say this device does not compare to Samsung, it wasn’t even on par with what I previously had, it was a disgrace of a device and couldn’t keep up with the technology Samsung has in their devices, I regret ever TRUSTING the word of a salesperson and being so gullible.

Thus, I was utterly disappointed in having fallen for the sales trick and not sticking to my gut and going with a device I am fami**** with and rather waiting for additional finances instead of hopping into a LOOPHOLE proof in STORE CONTRACT – as a consumer legally I store should allow you 7 – 14 days to return an item if you are not satisfied with your purchase, this is not the case for a “Franchise” owned in Vodacom store, legally you have 1 DAY to return the device and then have the contract cancelled, if you do not comply you have to hope something went wrong with your device as the 7 day term only applies to the “out of box failure”.

Then on the 13th of October 2022 I went into the store and I wanted to return the device with all the accessories it came with, it was neatly packaged exactly as I received it that day and in the same condition as it was handed to me, I was blatantly told that they would not assist me in cancelling the contract and the only way they would consider assisting me was if “it was an out of box failure” AS MENTIONED ABOVE, I was so taken back and felt like I was being treated unfairly as a customer and consumer and as if I HAD NO RIGHT AS A PERSON, even though I have the fullest right as a customer and consumer under law to return a product if I am not satisfied with it. They refused to assist me, they made me feel like I was the one in the wrong as the customer.

I have spoken to Nireshni Govender from retentions and she has calmed me down and made me feel like a customer again and made me feel like Vodacom was working on my best behalf as a customer, telling me she would gladly have cancelled the contract for me if she could as I am in my fullest right which falls under the 7 day period, and Nireshni has noted our recorded call on the system as I explained my agonizing experience with Vodacom Shop Clearwater Mall and the fact that they are only after the deal and do not care about the customer service after a sale and would do anything to keep the sale as my wife’s contract expires 1 November 2022 and yet the device was taken back to them pleading the case on the 5th day and now today the 6th day.

As I went into the store today believing I have the fullest right to cancel the contract as a customer and consumer, that was in fact not the case, as I was hit with the LOOPHOLE as explained – 1 DAY return/refund policy, they eventually agreed to log this as a “out of box failure” but we know that the answer and result will be the same, I will receive the device back and will be locked into a 36 month contract on a device that was not suited to me at all. With all honesty, without the help of the retention team I would be stuck between a harder rock as they were the only ones willing to assist or try to assist me, them and the store owner of Vodacom 4U Elaine who said if it were up to her she would gladly have assisted me.

All I can say is, once this contract has ended I will terminate any ties INDEFINATELY I have with Vodacom and I will never ever recommend any person, not even my family members or their members to EVER CONSIDER VODACOM, I will gladly accept switching service providers as I pay your final 36 month contract and you shall never have business from my end in any given future nor my family and friends.

Regards Juan

Hi,

Thank you for your response. I am awaiting to be contacted on WhatsApp.

The resolve would be simple, they should cancel the contract upgrade and we all go on our merry way and my relationship with Vodacom remains a healthy long term relationship.

Regards
Juan

Hi,

Since there has been no formal assistance and I have constant excuses from Vodacom Clearwater Mall, I have taken it upon myself to formally lodge with the OMBUD.

The case will be closed once my issue is resolved.
