Vodacom does not honour agreements and are false advertising.
I have a major issue with Vodacom’s customer service. They do not honour agreements. 1. I selected the deal and contract and it was sent through to you in the 15th October. 2. I was then told the deal expired and to select a deal from the new catalogue( exact same phone and watch- advertised in the new October catalogue). 3. The phone was delivered without the watch. Nowhere was it discussed in the email trail that the phone was being sent to me and was not even informed that the phone was delivered without the watch. 4. Only when the porting enquiry came through and I was not happy with paying the full amount without having received the watch was I made aware that the line has been discontinued and at that point still not informing me that you will not be receiving the watch at all. 5. On Friday (15 November) I call you explain to you that I am currently using the phone and cannot return the device, you continue to tell me you are not certain when you will receiving stock. 6. I agree to keep the phone and wait for the watch till the end of the month and should it not a arrive I will then select a new device and only return the old device once I receive the new device. This is because my data has already been transferred to the new phone and my old phone has been given away to a family member. I have a family and husband that is based in Cape Town and I cannot be, at any point in time, be without a phone. 7. Yesterday on the 20th November ( bearing in mind I received the device on the 22nd October) nearly a month later I am told I need to return the device and place an order for a new device. This I cannot do. I find this unacceptable and very *********. My view is clear, Vodacom cannot request me to return the device. It is also my considered view that they should still honour the agreement and send me the ETA. When I selected the phone, there was an offer made to Vodacom. Upon them processing the order and dispatching the phone, that was a clear indication that they have accepted my offer. As a result, a valid contract now exist and by not delivering my watch, Vodacom is in breach and I can always decide to take this further. Vodacom cannot now request that I return the phone just because the line has been discontinued. What is clear is that the line was discontinued after I had made the order and which was accepted by them. As per the below catalogue, it is clear that this deal has been advertised from September and is still currently being advertised. It is valid until 8th December 2019 and customers have not received any communication alluding otherwise. Vodacom is clearly misleading us about the line being discontinued. If not, then they are falsely advertising the deal which is contrary to the Consumer Protection Act.
