VODACOM DISPUTE

GENERAL AFFIDAVIT RE: VODACOM DISPUTE 16 September 2020 Plaintiff: Mr. Leon du Plooy Id no: *** 097

Hereby I, MR LEON DU PLOOY, ID no: *** 097, Physical Address: 2A Wilge river Avenue, CASHAN, Rustenburg, 0300 - make oath and confirm the following information:

MY FORMAL STATEMENT: 1) I agreed to a Vodacom cell phone contract 2017 – 07 - 07. Contract: Caterpillar S60@ R749 PM (R550 Finance + R199 Sub) on uChoose Flexi 200. Contract 24 Months. Account No: I*** – 4 2) I also had two (2) cellphone numbers with VODACOM. Namely: *** *** I had these numbers for a few years and then suddenly they “deleted” these numbers and it was not working anymore. It was deactivated. I want these numbers back. Activated. 2) The first debit order was debited on the 30th of June 2017 confirming my agreement with Vodacom. The amount that was debited was R440.68. The second debit order that was collected was on the 31 July 2017 for R620.68 Third debit order collected was on the 31 Aug 2017 for R530.68 3) The contract schedule was for 2 years. 24 months – as mentioned on my contract. My contract had to end 2019 – 07 – 07. That was not the case. 4) I had to learn afterwards that the paperwork, therefore my original contract for the above mentioned contract was only submitted on the 25 January 2018. 6 months after I signed the original contract in July 2017 but please keep in mind I have been paying the contract already for 6 months. My first and originally agreement was never processed therefore the company only processed a contract 6 months later and that resolved into a extension of 6 months on my contract that I did not give permission for or agreed to the upgraded contract in January 2018. 5) I did not sign the upgraded agreement in January 2018. Please see Annexure 1. I was unaware that my originally contract was never processed and technically lost. 6) I only signed the contract in July 2017, the original contract. The mentioned contract cannot be found on any system. It was miss placed (lost). 7) I cannot be held responsible for an extension on my contract of 6 months if I did not agree or gave permission to such an arrangement. I paid extra payments on a device, where I did not even had a warrantee on the device any more. My 2 years have lapsed therefore my debit order had to be cancelled. But that wasn’t the case Vodacom actually collected double payments via debit order. Please note I did not give them permission to do so. 8) I couldn’t get the contract cancelled. I logged the problem, trying to find out what is going on but it was never resolved. Service was poorly. 9) Therefore I gave my bank permission to reverse the extra fees that was asked. The result was that some of the payments couldn’t be reversed because of bank policy. The payments that couldn’t get reversed was for July 2019 and the amount suddenly was R 1 106, 55. Second payment that couldn’t be reversed was for R1 106, 55 on the 01 Aug. Please see bank statements attached. 10) At this point Vodacom phoned me stating that I owe them money for a contract that was already been paid up. I paid the payment for 24 months like agreed on in July 2017. At this point I went back to Vodacom at Rustenburg Waterfall Mall. Nicolene DearLove helped me with my inquiry. She was really trying to assist me and she was helping me as far as possible. She logged the inquiry and she phoned head office as well. The problem was not solved but like you can see on Annexure 2 she asked for a investigation in this matter. 2 months have passed and nothing happened. 11) It only ended up at the Attorneys. Vodacom handed me over to the debt collectors, MBD – ***. This is resulting in me having a bad record. I am in the process of buying a house and could not go on with the transactions because of this dispute. 10) I have been trying to resolve this matter on my own but even after I have logged the problem or enquiry again on the 2020 – 07 -14, nobody called or made an advance in trying to resolve this matter. Therefore I am urged and forced with the fact that I need to involve legal advice at this point. 11) I need this matter resolved as quickly as possible.
