Vodacom Damaged my brand new iphone 11 and is taking forever to sort the issue out

About a month ago I had upgraded to a new iphone 11 with vodacom on a x36 month contract which I took out at Cellucity in Sea Point. The OS was glitchy so I sent it back to be repaired and Vodacom said they found no fault despite the guys at cellucity verifying there actually being a problem with the device.

Here's where the problems start, I had the device for just over a week. When I got it back from repairs, the device was full off scratches and had a chip on the bottom left corner of the device. It wasn't cared for when they sent it out and just wrapped it in some bubble wrap and put it in a plastic bag and shipped it to century city. Cellucity and Vodacom said they would investigate the issue and have kept my device for about a month now and I'm still getting billed.

I contacted Vodacom repairs in century and they said the phone didn't get sent back after being sent the first time, they called Cellucity in Sea Point and the manager Matthew, told me on the phone he had forgotten about the device?!?!?

He then told me on the email he was too busy to sort it out. This is getting out of hand and it seems like no one is willing to help me out here.

So Vodacom agreed to exchange the device for a new one, but during the exchange from Century City to Sea Point. The Courier either stole or misplaced the device and now I have to wait a for a further investigation... Keep in mind I had this phone for 2 weeks and Vodacom has been " investigating " this issue for coming up to 2 months now. I'm left without a phone and I'm paying for this expensive one that I don't even have, I'm having sleepless nights and running out of patience. This is really disturbing me as I got the phone for the camera and I've lost time I will never get back... I have no idea how Vodacom expects to compensate for this as it's long past the " We'll just replace your device. " I feel like a lawsuit is now in order.
