Vodacom Con - tracts

In February 2015 I was conned into a contract by Vodacom. (Reference Number: ********** 7) (Phone number: ********** ) (Account number: I ********** )

Like the Cautious consumer that I have become in this country, I made sure to ask many pointed questions about the contract. Vodacom claims that these conversations are recorded, and can be made available at any Vodacom shop.

Neither have they honoured the verbal contract, nor have they provided access to the recording of this contract. Back in July of 2015, after Vodacom had proven that they had conned me in three specific ways, Namely that there was (1) an attempt to charge an "in store activation fee" for a over the phone contract. (2) The contract price increased by 10% in the second month, and (3) the data top up was not pro rate Rand for megabyte the same as the contract price, as was promised. In fact I was charged pay as you go rates to top up data! I reported the matter to ICASA. ICASA left me hanging till August of 2016 and sent the following reply:

"We have received the communication regarding a complaint addressed to ICASA for mediation. Your Complaint has been registered and the ICASA Complaint Reference is: WCP2245/16. Your complaint is beyond our jurisdiction..."

Since saying "Yes" over the phone to Vodacom, based on the deliberately false and misleading answers to my questions, Vodacom has ignored all communication, has continued overcharging me, has refused me access to the recording of my verbal contract, has severely damaged my credit rating because I stopped the incorrect debit order, and handed me over to Hammond Pole attorneys for "Debt collection".

I have complained to ICASA again, and am awaiting their feedback. However Vodacom in there usual underhanded way only communicates via phone calls. I was called yesterday to be informed that Vodacom is dropping everything, and cancelling the contract, (which actually ended months ago) but that they will not be providing me access to the recording. When I pointed out that this is not a solution, considering the direct damages to me, because of the ********** actions of Vodacom in this matter, I was advised that their legal department will have to deal with that.

Vodacom has not followed any legal requirements regarding the access to the recording of my verbal contract, but have ignored a registered letter of demand addressed to The Directors of Vodacom PTY LTD sent by my legal representative on the 13 September 2016. (PE ********** 59ZA)

When taking out a contract with Vodacom, please be sure to only accept the contract once they have provided you with a copy of the recording, otherwise you will never get it out of them, and they will chop and change anything they want with the terms and conditions you never agreed to. Then they will run you threw their mill, and even take legal action against you which in reality is the very definition of *****: wrongful or ******** deception intended to result in financial or personal gain. The only party who benefited from this Con-tract is Vodacom.

Seriously poor customer interactions with Vodacom, for one of the largest communications companies in Africa, they are seriously poor at communicating in their organisation, and with their customers.

One of the biggest communications companies in Africa still refusing to communicate with customers, and still refusing to follow the Law on access to information by making available the recording of my contract! Failure, Stay away from Vodacom.

Eight years later, and Vodacom has not done anything to fix this situation. If anyone finds this complaint, Vodacom never refunded the overcharge on my account, let alone compensated me for the losses directly caused by Vodacom's incorrect reporting to the credit bureau that I am in arrears, which prevented me from getting a critical business loan. I will never do business with Vodacom, and I will never stop reminding Vodacom of what they did to warn anyone from doing business with Vodacom.
