Vodacom Clearwater Mall refusing to replace brand new defect device
Terrible!! I bought my Samsung S22 Ultra from Vodacom Shop Clearwater on 15 March 2022. Four days after I have the phone I noticed a dead pixel on the screen. It is a clear green dot that is clearly visible at night. The dot is not clearly visible during the day or in a bright room.
I took the phone into the store where I requested a new device. They explained that there is Out Of Box failure period for which I qualify and need to send my device in. I did explain that under the Consumer protection act section 55 and 56 it states that I have a imp**** warranty and I do not want to send the device in for the reason that I am sitting without a device, THAT I AM STILL PAYING FOR. Vodacom is refusing to refund and cancel my contract OR replace the device.
The manager, Asthe, advised me to send the device in, where Vodacom will replace this device for me, but a investigation needs to take place.
The vodacom technician said he found no fault on the device and is sending back the device to Vodacom for me to collect. Clearly the technician did not follow instructions where I explained the fault is clearly visible in A DARK ROOM! BTW this is going to take another week for me to get my device back.
I did NOT pay for a repaired or faulty device. I paid for a new device without any defects.
Now Vodacom requires me to collect my device, take a video of the defect and send it back for the 'Review' or what ever that BS is!
IMPORTANT NOTE: I was able to show the Vodacom Consultant, Lucia, the defect and she confirmed the defect.
Vodacom is this really how you treat your Customers? Samsung is this acceptable?
It is unfair to keep paying for a device that I do not have. I want the device as my old device is broken. No Compensation from Vodacom.
Vodacom I promise I will not leave this issue only here on HelloPeter. I need feedback from you ASAP. I will take this matter further
Even though Vodacom sent the device back at first saying nothing is faulty, Asthe resubmitted the device on her own, with clear evidence and Vodacom is replacing the device today.
It is just sad that you have to fight with Vodacom before your voice is heard.
If a device is defective and the store can clearly see the defect, just replace the device Vodacom!
No need for your BS policy of "Yeah but our Technician needs to check it...", come on...
The Out of Box policy that Vodacom has is anyway BS as well, The CPA will overrule that anyway, Please see section 55 and 56 of the CPA of 2008 Vodacom.
`55 (2) Within six months after the delivery of any goods to a consumer, the consumer may return the goods to the supplier, without penalty and at the supplier’s risk and expense, if the goods fail to satisfy the requirements and standards contemplated in section 55, and the supplier must, at the direction of the consumer, either— (a) repair or replace the failed, unsafe or defective goods; or (b) refund to the consumer the price paid by the consumer, for the goods.`
So no Vodacom, That 'We will replace it within 7 days out of box' is not going to work, CPA states that within six months THE CONSUMER( `at the direction of the consumer` ) has the choice to get it replaced if criteria is met stated in section 54 and 55.
