Around May 2018 I received a call from a telemarketer consultant offering me a Samsung Galaxy S9 mobile phone as an upgrade on the contract that my wife was using at a ridiculously low price per month (Around R100p/m more than what we were paying at that stage.

When I queried the low quotation I was told that because it is only a Top-up account they can offer it at that price and I accepted it.

This call came in on the Bluetooth system in my car and my wife was witness to all that was discussed.

About 2 weeks later I received another call to confirm that I am taking this Samsung Galaxy S9 as upgrade on my wife's contract but this time at more than double what I was quoted the first time and I refused it then. I also informed them that for that price I would prefer that the contract be cancelled and we would then use this number as a Pay-as You-Go.

The consultant then responded that he/she will follow up on the original call and then contact me again - Which never happened.

Sometime in the first week of July 2019 I received another call to enquire if was satisfied with the Samsung Galaxy S9 phone that was delivered to me.

At he time of this alleged delivery I was camping at Voetplaatpark near Port Shepstone on the KZN South Coast .

When I explained to the consultant that called me that time that I have no knowledge of such a delivery, I was given an email address of a Manager as well as one at the Vodacom ***** Department. Please see the emails below.

About two months ago (Shortly after I was retrenched by the company that I used to work for.) we (My wife and I.) received a phone call concerning the upgrade of her phone. The contract she uses is one that I took out for her in my name but she is the primary user of this number ( ********** ). Payment for this contract is per debit order from my FNB account.

The phone that was mentioned was indeed a Samsung Galaxy S9 and the price that was quoted was about R100 more than what I paid at that stage and I still mentioned to the person that I spoke to that it was hard to believe that I could get it at that price. I was driving at the time and this call was taken on the Bluetooth handsfree system of my car so my wife heard every word that was said. Then we lost connection and I waited for this person to call again but nothing happened.

About two to three weeks later we received another call to confirm that we did order this phone at around R1000p/m and I said that that was not what was agreed upon and that I am not interested in this upgrade at that price. The person that I spoke to mentioned some other instruments in the same price range as what we currently pay and said she would come back to me to change the order. This was again over the speaker system in my car.

Thereafter somebody phoned again on that number but always when my wife and I were not together.

This week we received some calls during which it was mentioned that this phone was already delivered to us and that we accepted delivery of it. This is most definitely not true.

We are currently on holiday at the South Coast near Margate (Since 14 June 2018 – Please see attached email.)) and did not receive such an instrument before we left Gauteng.

Please see where this instrument was delivered to and who received it and signed for it (Various documents containing my signature are attached as proof of my signature.).

I will also appreciate if you would supply me with copies of the POD of the instrument that was allegedly accepted by me so that we can follow up on who really took delivery of this instrument if it was indeed delivered to- and received by somebody.

I am eagerly awaiting your positive response about this matter and will most definitely take this further if I receive any (increased) charges for this mess-up.

If you can write a letter disputing what is happening in your account and that you you did not recieve the cellphone although on our side it shows that you recieved it. Put your signarure 3 times anywhere in the letter, and also attach along a copy of your ID. Please send it to ********** Thank you

All the documents as requested were forwarded to Vodacom on a good number of occasions (I kept all correspondence and can forward it to whoever supply me with a valid email address.) but to date nobody responded to my request to be informed of where this instrument was allegedly delivered to and who accepted delivery of this instrument but that doesn't prevent them from trying to debit this (Increased) installment from my bank account (Which I blocked at my bank.) or to call me almost on a weekly basis about this account and when I explain this whole story to each new consultant that calls me I only get promises that this matter will be resolved soon or I am supp**** with invalid email addresses to which I can forward previous correspondence . Sometimes I was also informed that a Supervisor or a Manager will call me back or somebody will send me email addresses to which I can forward proof of what I tried to explain.

I only want Vodacom to:

1. Stop harassing me about this instrument that I never received; 2. Inform me of where this instrument was allegedly delivered to and of 3. Who accepted delivery of this instrument because it definitely wasn't me.

If I can receive this requested information I can at least go to the SAP and hope that they can be more successful in trying to locate this instrument if it was indeed delivered to- and accepted by somebody but that somebody most definitely wasn't me.
