Violation of the consumer rights as per the Consumer Protection Act
I signed a contract with Vodacom at the Vodacom store in Northgate on the 24th of July 2020 of 36 months to purchase a Samsung Galaxy Zflip. After struggling with the android system overnight as a common IOS user l decided to return the phone the next day on the 25th of July 2020.I spoke to the assistant manager(Aggie) about my predicament and at the time requested that l change the phone to an iphone 11 pro. She denied this and advised that l come see the manager on the 27th of July 2020. I then called the manager on the 27th and made the same request to her, reminding her of the CPA and also highlighting to her that after perusing through the contract l have noticed that there is a page regarding the customer selection confirmation that l didn’t sign. She reverted to me after contacted the regional manager and made it clear that l can not change phones or cancel the contract with no repercussions. She also mentioned that the contract cooling off period only applies on online purchases. She suggested that we hand over the phone for OBF where it will be checked for faults and if successful then we can change the contract and if not then there nothing they can do. Therefore, l handed over the phone at the store on the 28th of July 2020 with the hope that this will be accepted and we will change the phone. The store manager then contacted me on the 6th of August 2020 and informed me that the OBF assessment had been unsuccessful and that the phone was available for collection on the 7th of July 2020. I have not collected the phone and called the manager to inform her that l wont be collecting it and l will be contacting the NCC. Which l have done as well. l still get statements regarding this phone and l would like this to end.
