Unhappy with 36-month contract

On Thursday, 2 September, an agent called me with information about a new contract, which I accepted telephonically.

On Monday, 6 September, another agent called me to confirm the order. She mentioned that the new contract was for 36 months, which I didn't realise. She said that she will ask the first agent to call me back, but I have not heard from her.

After not being called back, I have sent numerous emails (starting on the 8th of September) stating that I am unhappy with the 36-month contract, but I have still not been contacted by anyone to discuss! I have also not received anything in writing explaining the terms of this new contract.

In the original telephone call I was told that I can return the phone if I am not happy (can't remember the exact cut-ff period, but I am sure I am now past it), but how can I do that id I am being ignored?

They duly phoned me the next day (note: the only way to get Vodacom to respond is to complain here), saying that they will urgently escalate the case to someone more senior. It is now a week later and I have still not heard back.

I can clearly see that my "new" contract has taken effect (amount deducted at month end, for instance), while I am still disputing the 36 months of this contract! I have clearly stated that I would rather go back to my previous contract or shop around for a 24 month contract from another company.

Now, 2 weeks later, still waiting on that second call. I have no idea how they're going to sort out this mess, except but shortening this "new" contract to 24 months instead of 36 months.

They said they have been trying to get in touch with me, but were not able to, so have sent me an email. It said:

"Kindly note that our Upgrades/Sales Team has been trying to get in touch with regards to your Hello Peter complaint with no success.

Please do let me know once you available or provide us with your direct contact number."

I have rep**** 3 times to say "I am available now", also saying that I have no alternative number.

They have responded with:

"Thank you for your reply.

We have requested the team to make contact with you and further assist.

Regards

Consumer Website Team"

I need a new phone! I have not used the one sent according to this contract, because I don't want this contract! At the moment I just want to end my (decades long) association with Vodacom and start somewhere new!!!

Does this mean I am now stuck with a 36-month contract that I already said on the 6th of September that I do not want! You record your calls, you must have a record of it!

It's amazing that they managed to get hold of me when they wanted to offer me the new contract, when they wanted to confirm that I want it (when I said that I don't) and after I first complained, but not since...
