THEY THINK THEY ARE ABOVE THE LAW

I never realised that Vodacom is so willing to just abuse my rights as a customer as much as they can. I came to upgrade my phone last Sunday at Vodacom Paarl and I was directly marketed by an employee about how amazing the new Samsung is. Being feeling pressured to buy this device from the employee and a Samsung adviser (or something along those lines) I decided I should get it because It sounded great. Myself knowing well the Consumer Protection Act, I knew that if this was not sufficient for my business needs, I knew I could come back in the 5 days as stated in16.1 of the CPA on 16.3 states that after direct marketing I have 5 days to return the phone. Or in the Electronic Communications and Transaction act that says on 44.1 that I have the right to a cooling off period after being directly marketed to, by staff. But I was wrong, Vodacom feels as If they are above the law, they do not stand with my rights as a South African and denied my right to return the phone (which was in a spotless condition the only problem was that the employee opened it in the store. Another family member is in the same issue as me she was pushed into getting a Huawei by another Vodacom employee and now both of our time has run out, which seems purposefully on their side. I asked for the contract I signed and I was not given the right to see that, "the branch that I upgraded from said that they could not provide me with that information. Called Head Office and I had to wait on hold for ten minutes after I told the employee that I would like to see my agreement so I could truly see that they do not abide by our CPA. But they seemed to avoid me. I called them again the second time around and finally, after tons of waiting, I finally got told she would send me my agreement, but I never got it. The fact that the company can shamelessly directly market to people and not give them their rights in the store honestly disgusts me. But what makes me angrier is those people that actually send half of their salary every month or those that pressured by Vodacom to upgrade to certain phone in-store or through your massive marketing campaigns. Those people don't have the rights to give their phones back, they are suffering because they were pushed into a contract and Vodacom group sits shamelessly, occasionally they get angry and put the phone down on you. The most ironic part is that when I was considering investing in Vodacom I saw so many articles about how Vodacom fully abides by the CPA.
