Salesman denies wrong information given. Branch refuses to cancel contract

*I needed a mere simcard for an alarm system to send text messages to my phone when any of the different alarm areas were triggered.

*A young male salesman at the Vodacom Westgate branch sold me a R35pm (messenger?) contract because "it would work out cheaper" for the intended purpose. (No cell phone or anything else had been bought, ONLY a sim card on a sms package.)

* Approximately 2 months later I went back to the branch to cancel the contract because there were additional charges added per month for such text messages.

*When confronted by his manager, the salesman then changed his story and denied having told me that it was a straight R35 pm contract. (Of course he would?)

*Because of his denial his manager then refused to cancel the contract.

*It so happened that we then sold the property where the alarm system had been installed. I removed the sim card and subsequenly lost it - and I forgot about the contract and the insident The sim card had not been used for more than a year now.

*I recdently discovered that the R35pm fee was still being deducted from my Bank account. I then went back to the Branch and another salesman then said they could not do anything about it and that I had to call their cancellations department. I stopped payment of the debit order in the meantime.

* The cancellations department then referred me to their legal dept where I spoke to a consultant Tashin and subsequently to a supervisor Ashwin. He referred me back to the branch, or to their customer services to lodge a complaint because of the refusal of the branch to cancel the contract.

*Bulalani at customer services could not do anything to resolve the matter. I asked him to find out who at Vodacom can help me resolve the matter, but he is not coming back to me as promised.

*I refuse to pay any cancellation fees. I feel that Vodacom should rather refund me the contract fees deducted for the period that the sim card had not been used.

*It seems that there is nobody at Vodacom that is either willing to help me to resolve the matter, or that has the decision making power to resolve it. I am frustrated by this.

*I am also adamant that I have been misled from the start, and that I will therefor not pay any cancellation fees.

*So, Vodacom, please just cancel the contract and write of your intended cancellation fee. I repeat that I have only bought a sim card, for which you have already gotten far more than the value thereof.

*Your threats to blacklist me for this are not appreciated. I am sure that the CPA will protect me in a case like this.
