Refusal to cancel a Contract

I have a 24-month Vodacom RED Flexi 75 contract that started on the 30 June 2022 and ends on 29 June 2024.

On the 8 Nov 2023, I emailed Vodacom Customer Care to give written notice that I wanted to cancel this contract as I am currently working overseas. I received a Reference no of 002H5aJMN8BQ3VEC. However, no action was taken by Vodacom and my Bank account continued to be debited monthly.

I then contacted Vodacom telephonically on the 10 Jan 2024 and again on 6 Feb 2024. The Vodacom Customer Service representatives I spoke to, assured me that Vodacom would email me a Cancellation quote, which I was to pay, sign and then email Vodacom proof of this Cancellation payment with a copy of my ID book. No Cancellation quote has ever been sent to me, by Vodacom.

Over the past 5 months, I have also emailed different Vodacom departments on 5 separate occasions trying to obtain this Cancellation quote! My emails and calls are simply ignored, and my Bank account continues to be debited monthly. In desperation, last month I stopped the Vodacom debit order. Vodacom’s lack of service and the total disregard of a Customer is just totally unacceptable. Moreover, I believe that Vodacom, is in breach of Section 14 2(b)(i) of the Consumer Protection Act, as 20 working days for termination notice have long passed. I am thinking of lodging a complaint with the National Consumer Commission. Any advice from others who have been in this same situation would be appreciated.

Good day, I can confirm that the Vodacom Consumer Website Team did contact me and finally sent me a Cancellation Quotation, after 5 emails and 2 Consumer Service calls spanning a period of 4 months. However, the matter is still not resolved. Before Vodacom will cancel my contract, all arrears must be paid. As I detailed in my reply email to them, I am not in arrears! I emailed Vodacom Customer Care on the 8 Nov 2023 to cancel my account. Vodacom received this written instruction and assigned me a Reference number on the 8 Nov 2023. According to the Consumer Protection Act, Section 14(2) (b)(i), Vodacom is required to cancel consumers’ contracts timeously after having been notified by consumers and it also permits consumers to cancel any fixed-term agreement without reason by giving 20 business days' notice. My contract should therefore have been cancelled by Vodacom issuing a Cancellation quote, which I would have paid. Moreover, no further debits from my account should have been made beyond 20 working days after receipt of my Cancellation instruction i.e. 6th Dec 2023. However, Vodacom ignored my Cancellation requests and continued to debit my account in Dec 2023, and Jan 2024 to a total of R596.00. I stopped the debit order in Feb 2024. Vodacom again debited my account in Mar 2024 and I have reversed the debit order. I do not mind paying the Cancellation quote fee but I will not pay for services that should have been cancelled last year on the 6 Dec 2023! I have emailed the Vodacom Consumer Website Team all the relevant information and have also sent this information to *** who sent me a letter asking for payment on the so-called arrears. I have also asked for this matter to be escalated to Vodacom management. Once again, I have not received a reply from either party. Last year the National Consumer Tribunal imposed an administrative fine of R1M against Vodacom. “The Tribunal found that Vodacom’s conduct was unconscionable by imposing terms and conditions that negated the consumers' right to cancel their fixed-term contracts. The Tribunal also found that Vodacom’s conduct is unconscionable in that Vodacom continued to bill consumers after they duly cancelled their contracts or attempted to do so... By repeatedly denying consumers the right to cancel the contracts, Vodacom contravened section 40(1)(b) and (d) of the Act.” Please see https://thencc.org.za/media-statement-vodacom-found-guilty-of-contravening-various-sections-of-the-cpa/ It is interesting that this very practice that Vodacom was fined for last year is exactly what I am experiencing with Vodacom this year. Vodacom should be ashamed of it’s conduct. I have now lodged an official complaint with the National Consumer Commission to investigate this matter.
