Red Flexi 300 changed to Red Flexi 320 without written consent
Dear Vodacom Customer Care,
I place Vodacom on formal notice that the change of my mobile contract from Red Flexi 300 to Red Flexi 320 was done without my consent and without lawful prior notification, and is therefore unauthorised, ********, and unenforceable.
I did not agree to this amendment, whether expressly or tacitly. I did not receive any written notice, SMS, email, or other direct communication advising me of a price or plan change prior to its implementation.
Vodacom’s conduct constitutes a unilateral variation of a fixed contractual agreement, in direct contravention of the Consumer Protection Act 68 of 2008, including but not limited to:
1. Section 22: Right to information in plain and understandable language;
2. Section 48: Prohibition of unfair, unreasonable or unjust contract terms;
3. Section 49: Failure to draw material changes and financial implications to my attention.
Any reliance on standard terms and conditions, website notices, or internal policy updates is legally insufficient and does not absolve Vodacom of its statutory duty to provide direct, provable notice to the consumer.
I hereby demand that Vodacom, within 7 (seven) days of receipt of this correspondence:
1. Provide documentary proof of the alleged notification sent to me (including date, delivery method, and exact content); failing which
2. Immediately reverse the unauthorised change and restore my contract to Red Flexi 300 at the original agreed tariff; alternatively
3. Permit me to cancel or downgrade the contract without penalty, charges, or adverse credit consequences.
Should Vodacom fail to resolve this matter within the stipulated timeframe, I will proceed without further notice to:
1. Lodge a formal complaint with ICASA;
2. Refer the matter to the National Consumer Commission; and
3. Pursue any additional remedies available to me in law, including recovery of overcharged amounts and consequential damages.
This correspondence serves as a final demand and an opportunity for Vodacom to resolve the matter amicably. No waiver of rights is intended or imp****.
I expect Vodacom’s written response within the stated period.
