Poor services and Information Distortion by Franchise of Vodacom

I'm very much disappointed with vodacom and its chatz store at carnival mall the level of dishonesty being implemented by the Service consultants omitting the truth in products they sell to customer.

Firstly im a contract holder with Vodacom for the past 5 to six years with them never ever has my debit bounced i notice the was something wrong with my debit order not going off went to you chatz store at Mall@carnival on the 27/09/2018 to inform the that it seems to be a problem with their debit order process cause the were funds in my Capitec Bank from the 22/09/2018 cause the 25/09/2018 was on a tuesday a working day I paid R290.00 on the 27/09/2018 for R289.58 note vodacom needs to inform customer if the is a problem with debit order but being a loyal customer i did notice now im being slapped with R100.88 (SE ********** 2) with charge for the bounced debit order that i was not informed I notice it then informed the on the statement for the 03/10/2018 the R100.88 for the charge bounced shows up as being added on the 28/09/2018 so now vodacom is charging a bounced fee after i notice made efforts to pay it on 27/09/2019 this ******ion to say very least.

Secondly Took out the second line on the at chatz store at Mall@carnival on the 27/09/2018 due to the fact I was approved for a second line I was help by a lady consultant i asked the lady critical questions regarding when will the new contract be debited off, Is the any activation or subscription fee cause i know if you are taking a contract you fairly pay i think R202.00 if its a new contract but the Lady by the name of Miss Zandelee Smith advised me that it will be combined with my current contract i have with vodacom and i should not worry but after a couple of day i get treating call from the collection department of Vodacom informing me that the did not get the debit order for the new contract cause this days if you take a new line contract Vodacom will debit your account within 48 hours of taking the contract bear in mind i did ask the lady when will the debit me she proudly said end of the month and top of that the new contract and also i have been charged R148.28 for a Promo Incentive of 5GB which under the new contract the incentive its for 7 seven working days for free on their statement its a charge that to the new contract billing to R433.34, So the Chatz Store and Vodacom are misleading individuals cause it seems the chasing for the sales to increase with out looking at how the violating and impacting customers consumer rights by misleading people to bind them self into financial obligations that direct affect peoples financial planning and security in the name of chasing sales.

Please note the Consumer rights that were impacted by vodacom or the Third party consultant at chatz at Mall@carnival

1.The right to disclosure of information - Right to information in plain and understandable Language *I was never told about the debit of the new contract will be accepted within 48 hours.

2.The right to disclosure of prices of services offered - Suppliers are required to display of services in full views of consumers *I was never told that the 5GB of Promotional data was payable for the seven days it will be offered to so for me to choose if im accepting it.

3.The right to Fair and Responsible Marketing - Right to protection against bait marketing *The sales consultant **** to us due to a fact she was looking for a sale than considering the financial obligations that my affect or have an impact on my finances.

4.The right to protection in terms of trade coupons and similar promotions- Persons are not permitted to make promotional offers with the intention of not fulfilling them or fulfilling them in a manner other than as offered *The promotional incentive being charged under my new contract account.

5.The right to fair and honest dealing- Using unfair tactics or any other similar conduct when doing marketing services and goods, demanding payments for goods and services with out clear explaining it. *The eagerness to seal a contract sale not representing the values of the company you are representing.

6.The right to protection against false, misleading and deceptive representations - Vodacom Franchisee in terms of Chatz at Mall@carnival are not permitted to, directly or indirectly, provide consumers with false,Misleading or deceptive representations regarding goods and service.

7.The right to obtain notice for certain terms and conditions - Suppliers are required to provide consumer with prior written notice of clauses in agreements that may constitute a potential risk or liability to consumers. *A clear explanation that the new line will be debited of my bank account within 48 hours that was omitted out when i was asking critical questions which could have impacted the sale of the item or the salesperson felt to omit the information will help to accelerate the sales not thinking about how the sale will impact me financial.

8.The right to refuse prohibited transactions, agreements and terms or conditions – Suppliers are not permitted to make a transaction or agreement if the terms and conditions : impose an obligation on consumer to pay for debit order that bounced and not informing me while I took an extra mile to inform you and pay it within the time.

9.The right to fair value, good quality and safety- I was entitled to timely notice of any unavoidable delays in the performance of the services *Not being informed in time for the bounced debit order to avoid extra charges.

Kindly assist with investigation of the above cause the taking advantage of the black community’s because most of the reliable customer come from the black communities that have little of information regarding the malpractices by this big corporations like Vodacom and note i want the debit of R1032.77 to be review and adjust correctly.

So my query has just been added with another days now from 24 hours, escalated to 3 to 5 working days now it has been escalated to 5 working days to 14 working days in terms or the turn around time to assist financial implicated case for your customer, So your are meaning to tell me that you cannot provide me with answer for the gross incompetence of your business practices.

Kindly note that vodacom is taking me for ride now... this absolute unacceptable to impact my consumer rights don't even try to assist but always cannot even deal with my enquiry how can you take money of my bank account and offer a solution of crediting it back into your Vodacom Billing account it means you are not willing to refund it back into my account and it the wrong account of R148.28 only what about the R100.88 that was also billed a day after i paid your account on the 27/10/2018 and the Poor service part...Please this is not britain kindly credit the R248.28 back into my account and deal with the poor service and my impacted consumer protection act that safe guard my consumer rights...
