Poor service and incorrect billing from Vodacom, second consecutive month.

<p>"LEGALLY PRIVILEGED AND WITHOUT PREJUDICE OF RIGHTS"</p> <p> </p> <p>To whom it may concern.</p> <p> </p> <p>I refer to the abovementioned matter as well as to various e-mails sent to Vodacom, without any resolution or even feedback, other than "we have received your query".</p> <p> </p> <p>Kindly take note that Vodacom, for a second consecutive month, overcharged my account, allowing my contract line 071 *** ***x, ie the "2gig Data Contract" as were advertised by Vodacom at the time, to go out of bundle.</p> <p> </p> <p>I have not selected to have an open line contract for this line when I entered into agreement with Vodacom. I have contractually agreed with Vodacom that it should not allow my data contract to go out of bundle. Contractually, Vodacom was supposed to cap or stop my data usage once the 2GB threshold has been reached. They call it the "2GIG Data Contract" after all! Who would in any event in thier right mind pay the exorbitant amounts Vodacom charges for data out of bundle? Ie, why would I pay R3 600 for less than 1 Gig data when I can purchase 5 Gig data for R150.00?</p> <p> </p> <p>In my personal view this is nothing short of "corporate bulyism" and not an example of how you treat your customer fairly. </p> <p> </p> <p>What compound matters for the worse, is that I have contacted Vodacom last month to query the previous month's overcharging on my account with the aim to alert Vodacom of the fact that they have breached the contract we have entered into. Vodacom decided to refund the overcharged amount, but elected, at its own peril, to once again allow the data line to go over the contractually agreed 2GB cap. I have requested Vodacom to ensure, as per our agreement, that the data line will be locked at 2GB to prevent a reoccurrence of an overcharge.</p> <p> </p> <p>Last month (billing month of April 2016), I was charged an amount of R3 837.26. After my query was considered, Vodacom refunded the amount of R2 613.38. This month, (billing month of May 2016), Vodacom charged me an amount of R4 141.94, which I, yet again, vehemently deny is the contractual agreed amount that is due and owing to Vodacom.</p> <p> </p> <p>In an attempt to prevent a reoccurrence of an overcharge for May, and for incase Vodacom, yet again contractually defaulted to block the line after the 2GB threshold has been reached, I attempted to limit any possible damages I may suffer again herein by purchasing a 5GB data bundle on the 6th of May 2016. It seems however that my efforts were futile and Vodacom allowed my data line that was supposed to be capped at 2GB, to run over and charge me exorbitant charges for Data, which is definitely not how a responsible corporate should be treating its customers, and definitely not an example of how you treat your customers fairly.</p> <p> </p> <p>Further take note that the overcharging of my account have caused my banking account to go into arrears for a second consecutive month, which will have a severe influence on my credit scoring at the various credit bureaus. I am in the process to purchase a property, and I will hold Vodacom liable for any negative inference that may be drawn by my bank from the credit report.</p> <p> </p> <p>Kindly supply me with the following feedback:</p> <p> </p> <p>Why Vodacom again breached the contract we have entered into by allowing my account to go over the 2GB threshold again, even after I have requested you during last month to ensure that you activate the lock at 2GB as per our original agreement.<br />Kindly confirm in writing that Vodacom has now activated the lock at 2GB on this line to prevent a reoccurrence of the matter for a third consecutive time.<br /> </p> <p>Further to the above, Vodacom has e-mailed me my invoice for May, and it seems as if they have also, on top of the contract breach explained supra, reversed their descission to refund the amount of R2 613.38 and debited this amount to my account again!</p> <p>I have requested Vodacom to consider refunding the overcharge amount into my banking account, since same was debited ********ly and without my contractual consent thereto. I have not budgeted for this amount, Vodacom never alerted me that they will charge my higher fee, they just debited this amount out of my account. I do not have any money left to buy food for my family because of this. I have raised this with Vodacom on the 2nd of June already , I have not had any response.</p> <p> </p> <p>Poor, poor service. It seems that there is truth and a lot of inference that can be drawn from the findings that recently went against Vodacom in our courts.</p> <p> </p> <p>I fully reserve all my rights herein and look forward to your reply herein to settle this matter amicably.</p> <p> </p> <p>Trust you find it in order.</p> <p> </p> <p>Adriaan Jordaan</p>
