Pensioner to pay for Vodacom’s errors

I have now been without use of my cell phone number since October 2016 – almost a year. I reported the second ********** sim swap in five months and was totally left in the dark for months. After a previous Hellopeter complaint, the matter was referred to Vodacom’s ***** department. After several months the investigator found the sim swap to be **********.

In addition to the cell phone contract, I also have a wi-fi contract that was also disconnected by Vodacom.

The first contact from Vodacom was on 27/6 when Zanelle phoned me. I was given R2975.48 credit and was told to repay R1004.89 for the wi-fi contract for the four months when I still had use of it. The arrangement was that I would repay R252 per month for four months

I then received a threatening letter (dated 7 July received on 21 July) stating that I now have to repay R1134.84 instead of R1004.89 plus a hardware balance of R129.97 and a balance of subscription of R1624.43 totalling R2759.27.

I cannot understand why I have to pay these amounts as the breach of contract was not on my side but on Vodacom’s side. For almost a year I have had no use of these two contracts and I am still disconnected from the network. I also notice that the expiry date of one of my contracts have now been extended to March 2019. Surely this is not allowed as it is not in line with the agreement made between Vodacom and me.

I have been threatened with legal action – all of this caused by ********** sim swap that sould never have happened if Vodacom followed the FICA requirements for a sim swap.

I demand that Vodacom resolve this issue by reinstating my services and write off all the amounts related to these contracts. Why don’t you make up for the inconvenience caused by issuing me with a new free contract of 24 months?
