Out of Box failure and the Vodacom shop refuses to give me a new phone

I upgraded on 11 Jan 2017 a Samsung S7edge at Cape Gate Vodacom Shop as they explain the terms and condition you have 7days to return a handset that gives any kind of problems. The device was not tested in the shop it was opened to show all the accessories nothing else.
I charged the phone and the next day(12.01.2017) while receiving a phone call the handset's speaker made a terrible static noise that made it impossible to hear or make sense of the conversation. I took the phone back on 12.01.2017 to the shop their technician checked it and said it is a OBF problem. They need to book in the phone but it will be send on Monday 16.01.2017 so I said I will bring it back on 15.01.2017. During the weekend I contacted Samsung and they informed me that the shop should have given me a new device since it is a new purchase and it is Samsung's loss not Vodacom. I contacted Vodacom head Office and they also said that the shop should have responded immediately. On 15.01.2017 I asked to speak to the manager of the store and only the 2nd in charge was on duty and he said that the phone needs to be send to Durbanville repair centre to be assessed and they will inform the store if I should receive new handset or if it will be replaced. I conveyed the message of Samsung and he bluntly said that Samsung has no say it is Vodacom that needs to decide and policy is 7days send to repair centre. I said the phone was not tested on the day of purchase and he said it is not procedure and they are not required.
On 16.01.2017 I phoned Samsung again and they said that they have problems with the shops not giving Samsung clients new devices if it is in their 10day return policy(Samsung). For 3 hours I was on the line with Vodacom Headoffice. Repair centre and Vodacom shop cape gate nobody was willing to assist. All they had to do according to samsung is return the device to me so that I can take it to Canal Walk Samsung Smart Centre so that they can assess and write report for the shop that I can receive a new device. But no it needs to be SEEN BY VODACOM REPAIR TECHNICIAN since Samsung has no say.
This I do not understand it is a Samsung product how does Samsung have no say on how they clients must be treated because Vodacom receives the products from them???!!!!
The do not care that I need to fast track the process because I have a mobile business which means I am depend on my phone. I found a faster solution but Vodacom does not want it to happen like that. They want me to lose business for 7 days while THEY want to assess the device. And I KNOW THEY WILL REPAIR the device and it is unfair because the device was never used know I must pay monthly for 24months on a REPAIRED phone not a NEW device
