now 8 months still no joy

Good day

I trust you are well,

So after my below mentioned compliant for when my phone was booked in again for the 7th time. So far in dealing with Vodacom I have had 6 different Job numbers, and a phone that has not been working since 23/05/2017. The latest problem was that the earphone jack isn't working. When I originally went to retrieve the headphone on Saturday 03/02/2018 I noticed the phones head phone jack wasn't working. I was immediately advised that due to the fact that one of the consultants headphones worked in my phone and that my head phones didn't, I have a pair head phones that "isn't compatible with Sony". I later contacted Sony directly and inquired as to whether or not there is such a thing as Sony compatible headphones or not? Sony Mobile responded with the following:

" Good morning, Robert

From what we understand, there are no Sony Mobile comparable headphone jacks. However, some headphones are generally problematic and do not work properly on our devices.

The standard jack should work. Please provide us with your contact details and so we can assist you with the issue.

Kind regards, The Sony Mobile ZA Team "

So to ensure I don't own a pair of generally problematic head phones I retuned to Vodacom today 07/02/2018 and I asked the consultant with whom I was dealing Kabelo if we could test my head phones on her phone and they did in fact work. I have also tested my Volcano head phones on a colleagues' LG Smart phone (I forget the model name) and they worked on that phone too.

So to summarize I have been without a phone for over 8 months now and not once has a replacement phone been offered by Vodacom for me to use in the interim although I am being charged a monthly "phone rental fee" if I am reading my invoice correctly. Never mind offering a replacement phone of equal market/retail value that is able to fulfill the same advertised functions as the phone I am currently paying for on a monthly basis. At this point by my estimates I have had to make over 8 trips to Vodacom due to this poor service delivery as well as a faulty product which they have sold me without once offering compensation or reimbur*****t for the money billed for the unit thus far or the time spent driving back and forth to Vodacom to have the issue resolved. Secondly I have already had to spend out of my pocket for a sim swap which upon further analysis was deemed unnecessary and I was re-reimbursed after R 69 after 2 weeks, if I had followed the advice I had received from the Vodacom consultant I would be even further out of pocket after going and searching for a Sony pair of head phones hoping they would be compatible with my phone. Thirdly in this process Vodacom has lost 2 vital pieces of equipment necessary to operate my phone: 1)the Micro SD Tray and 2) Micro Sim Card Tray (Excuse me unsure what mobile industry jargon is for the 2nd term hopefully you know what I mean).

I would like the following 2 things:

1) A copy of my legal contract I signed agreeing to a cellphone contract with Vodacom stating all the terms and conditions 2)The contact details of the industry Ombudsman

Because seriously at this point, I have been left with no other options I have paying for a phone I haven't been able to use. Not once have I been offered a replacement phone of equal market value. I received an sms today telling me that I may be due for an upgrade soon. So when I asked Tebogo what phone would I be able to upgrade to without paying anymore than I am currently because as it stands the way I see it my relationship with Vodacom is costing me time and money, to which his response was it's highly unlikely you'll be able to upgrade and remain on the same payment. So then my question would be since my contract is due for an upgrade have I paid back this faulty phone or not? Why would I now have to end up paying more if I can identify remain on the same plan I am on now and identify a cheaper more reliable phone to pair it with?

Kind regards
