Not compying with RICA legislation

After porting out from Vodacom on 01/12/2016, on 30/03/2017, I received a frantic call from Vodacom Accounts department on my husband’s phone, ***, stating that my account was in arrears. I explained to the consultant the problem that I am faced with and he told me that he is just dealing with Accounts outstanding and that I should speak to someone from Cancellations.

On 31/03/2017, I went to my local Vodacom shop and attempted to speak to the manager, as she was assisting with my query previously query on the matter that was referred to Vodacom's ***** department. She told me that she was busy with meetings the whole day and that I need to come in the next day. On 01/04/2017, I went back to the Vodacom shop and managed to speak to the manager, she again checked on her system and explained that after numerous calls to follow up during the month of February 2017 by myself and the local Vodacom shop, the Vodacom ***** department has still not responded to her and she can’t do anything to help. She advised me to speak to Vodacom Legal department, which I attempted to do.

After I initially saw that my Account was debited at the end of January 2017 again by Vodacom, after my account with Vodacom was ended on 01/12/2016, I instructed by bank, to stop the debit order from my account, pending feedback on the ***** case opened.

As per my discussion with Zodwa Mnisi from Subscriber Collection department on 01/04/2017, I provided the proof of porting from Vodacom to CellC on 01/12/2016.

According to Vodacom's records and as per my proof attached, when I ported out on 01/12/2016, Vodacom created a “ghost” prepaid contract, number ***, I have queried this with my local Vodacom shop and phoning numerous times into Vodacom Customer Care centre with no satisfaction.

As per the Vodacom consultants that I queried this with they assured me that the porting would not have been allowed had there been any outstanding amount on my Vodacom contract. Also, I would like to enquire from Vodacom why they opened a new contract on my name without consulting me. In terms of RICA legislation this is *******, as the new number and account have not been verified in terms of RICA requirements. I further went to my local Vodacom shop and as per the standard procedure from Vodacom the consultant explained that if all necessary back-up documentation related to RICA has not been uploaded a contract cannot be released. We checked my previous number, and the documentation was duly uploaded, as for the new number, no documentation was uploaded. This is against Vodacom requirements and ******* in terms of RICA legislation.

I have spoken to numerous consultants, in the following departments, Accounts, Legal, Customer Care and tried Cancellations also, but when I enter the number this query relates to in cancellations it tells me it is not valid and the line goes dead.

I have tried my very best to try and sort out this issue with Vodacom, but I am continually put through to other departments not able to assist. I am very concerned that Vodacom will blacklist me for failure of payment, but I have tried to sort out this mess with Vodacom and no one is able to assist.

Subsequently Vodacom has handed that matter over to MDB attorneys, I have provided them with a Sworn Affidavit on the matter and back-up documentation proving attempts to sort the matter out with Vodacom.

The reason I have referred the matter to HelloPeter is that it feels as if the attorneys are only interested in recovering the amount Vodacom claim is outstanding and not addressing the merits of the case.

Please assist with further options as I don't want to be blacklisted.

Dear Vodacom Escalation Support Team, Thank you for your feedback and report, but as per my further responses, I am in meetings during the day and have requested a contact number to discuss the matter. Vodacom has basically agreed that you created a "pseudo" number, which in terms of the RICA principles amounts to the need to have a contract in place, as this is the number that the dispute relates to, and therefore amounts to *****. I have not received any response from the appointed attorneys by Vodacom on the matter although they quite frequently made contact prior to submitting my documentation. Please contact me before 08:00 in the morning or after 16:00 in the afternoon to discuss the matter further. This will ensure that I am not in a meeting if you try and phone. Best regards, Lurinda

Dear Vodacom, I am writing to you yet again, after speaking to MDB they request that I must submit a copy of my ID for Vodacom to escalate the matter to be investigated. Should this have happened before the case was referred? Also, I explained to MDB that I would like to understand the reason why my ID is needed, because as per the POPI Act I have the right to know. Further if the correct RICA legislation was followed, surely Vodacom would have had a copy of my ID. Please advise further. Best regards, Lurinda
