MONEY DEDUCTED FOR NON-EXISTANT CONTRACT
<p>Good Day On 20 April 2016, I went to Game Stores in Northam Limpopo to take out a cell phone contract (Vodacom). I was assisted initially by Sinha although there are also some few others helping out when she is unavailable. For the main part of my complaint Sinha was the assistant. Whilst completing the application form for the contract, I told Sinha that I wanted to keep my current Pay as you go cell phone number. She said that is not possible for them to do it in store, I should do a sim swop afterward with Vodacom directly. I received my phone and left the store. I called Vodacom to request the sim swop, and I was told by them that the SIM was not activated and I need to go back to the store. The next day (21 April 2016), I informed Sinha what Vodacom has explained to me and she told me that she has just activated it and showed me on her screen. I then said to her again that it is showing as activated on a new number as I saw it on the screen, and I told her that I wanted to keep my old number. Again she said I should do a sim swop with Vodacom. Then I left again. I phoned Vodacom and they explained that I cannot do a sim swop from a prepaid to a contract, the store should have just activated the new contract on the old number – which did not happen. I once again returned to Game but by this time I was quite fed up and also realized that when I did my application I chose the 29th as my debit date and they have debited my bank account on the 25th. When I visited the store again on 30 April 2016, I asked to speak to a manager. I explained my situation to the store manager Wimpie, and said that I wanted to cancel my contract reason being misled information: 1. The number issue where Game told me that I must do my own number change with Vodacom and where Vodacom explained to me that “that the lady that did my contract didn’t do it correctly” 2. My debit date is incorrect, the one on the application that I completed and the actual debit order is different. He apologized and asked me can he not try to resolve the matter for me. I agreed by the following statement that was made: “Sir, I have a contact at Vodacom Finance Department, that I will talk to and try to sort out the matter for you because we did have a similar complaint from a lady that bought a laptop and I did manage to resolve the matter for her”. It is now 13 May 2016 and the matter is still not resolved. I would like to cancel my contract because of the breach of the contract at the store. Can someone please assist me in the matter? Please note that I have only used the cell phone the 1st week I received it mainly to resolve the sim swop matter with Vodacom. Since then the phone has been sitting in its box – unused as there is nothing I can do with it.</p> <p> </p> <p>UPDATE:</p> <p>I received a call from a snr manager from Game where I was placed on a three way call between myself, him and Wimpie vd Merwe (Store Manager - Game Northam). Wimpie requested that I come in to the store personally so that the matter can be resolved. I went there the same day and Wimpie explained that the contract was cancelled and therefore I gave him back the cellphone. He said he will arrange that I get refunded from Vodacom as there was moneys deducted from my bank.</p> <p> </p> <p>Can you please explain the following:</p> <p><br />1. If the contract (according to Game) was cancelled 3 weeks ago, WHY was there a deduction to Vodacom on my bank statement at the end of May 2016??</p> <p><br />2. Current money already paid over to Vodacom / Game by myself was as follow: R202 registration, R199 end April & R199 end May.</p>
