LG phone with headphone advertised but wait month

I upgraded to a LG G3 beat which was advertised with headphones. When I upgraded the store did not had the headphones but told me I can collect it in one week. I now visited the store on a weekly basis for one month but still n headphones. Is that not breaking of contract of false adverti*****t?
