Legal action to vodacom

Dear Mr. Shameel Joosub and Vodacom Executive Team,

I am escalating this as a final demand before legal action. Vodacom has breached my warranty, damaged my property while in your care, and caused me ongoing business loss.

1. Timeline of facts 17th March 2026 *** I Submitted my Samsung Galaxy S25 Ultra to the centurion store for warranty repair.

Fault: power issue only. 24th March 2026 Vodacom returned device with NEW faults: audio failure, display defect, alert/notification failure, back cover unsealed, S-Pen non-functional. Original power issue unresolved.

30th March 2026 i Re-submitted immediately due to Vodacom’s damage. ***

20th April 2026 my Device is still with Vodacom Advanced Repair Centre. 1 month + with no resolution. Agent "Oga" states only "we need more time" and "nothing else can be done".

2. Vodacom’s breaches 1. *Consumer Protection Act 68 of 2008, Section 56(2)*: I elected repair. Repair failed and has not been completed in a reasonable time. I am now legally entitled to a replacement or refund. 1+ month is unreasonable. 2. *Negligence*: Vodacom returned my phone in a worse condition than received. Damage occurred while in your possession. 3. *Breach of service*: This is a business line, No loan device issued despite repair >7 days. I am losing income daily.

3. Resolution demanded I require the following *IMMEDIATELY* from date of this email. 1. Immediate replacement with a brand new Samsung Galaxy S25 Ultra, same colour/storage. If no stock as mentioned by Oga then i want the s26 ultra brand new sealed, 2. Compensation for proven business loss from 30th March 2026 to replacement date. 3. Written confirmation of fault and apology for negligence.

4. Next steps if ignored If not resolved by 21st April 2026 I will without further notice: 1. Lodge formal complaints with ICASA and the National Consumer Commission, citing Section 56 CPA. 2. Proceed with legal action in the Small Claims Court/Civil Court to recover replacement cost, consequential business losses, and legal costs. All calls, emails, and repair notes are documented.

This is a final letter of demand regarding Vodacom’s breach of warranty, negligence, and failure to resolve Ref ***2 after 1+ month.
*1. Your response to date is inadequate*Vodacom Head Office has contacted me only to “verify contract information”. No resolution, replacement device, or compensation has been offered. This is unacceptable.
*2. Facts not in dispute*1. My Samsung Galaxy S25 Ultra was submitted under warranty on for a power fault only.2. Vodacom returned it with new damage: audio failure, display defect, alert failure, unsealed back cover, non-functional S-Pen.3. Device has been with Vodacom for 1+ month since re-submission on. No loan device issued.4. This device is used for business and I am incurring daily losses. 22nd April 2026!
*3. Vodacom’s legal breaches*1. *Section 56(2) Consumer Protection Act 68 of 2008*: After failed repair + unreasonable time, I am entitled to replacement or refund. Your time has expired.2. *Negligence*: You damaged my property while in your care. You are liable.3. *Breach of contract*: Failure to provide service or loan device.
*4. FINAL DEMAND*I require the following by *17:00 SAST on 22nd april 2026:1. *Confirmation in writing* that a brand new Samsung Galaxy S25 Ultra will be issued as replacement, with collection/delivery date.2. *Confirmation of compensation* for business loss from to date of replacement. losses incurred since 17th March 2026.3. *Loan device* delivered to me within 24 hours if replacement takes longer than 48 hours.
*5. Consequence of non-compliance*If I do not receive written confirmation of points 1-3 above by today 22nd April 2026 at latest 4pm COB, I will on without further notice: 23rd april 20261. Lodge formal complaints with ICASA and the National Consumer Commission citing your breach of Section 56 CPA.2. Institute proceedings in the Small Claims Court/Pretoria Magistrate’s Court for replacement cost + R50000 in damages + legal costs.3. Report Vodacom to the media and HelloPeter regarding warranty negligence.

I Do Not Accept Different Colour - Section 56 CPA
Dear vodacom executive team,

I do not accept a replacement in a different colour.
Under Section 56(2) of the Consumer Protection Act, I am entitled to replacement of the same goods I purchased. A different colour is not the same goods.
*I elect one of these 2 remedies only:*1. *Replacement with brand new S25 Ultra same as my original device, OR2. *Upgrade to the s26 ultra with no added costs due to vodacoms neglegence and breach of warranty.
Please confirm in writing by *16:00 today 22nd april 2026 which option Vodacom will proceed with.
If Vodacom cannot source of device purchased, same colour storage, then option 2 must be actioned.
I reject a different colour as settlement of this matter.
