******* deduction notification

I received this sms today: Vodacom Contract Cover is active at R6.99 per month. Your contract balance is covered in event of death. T&Cs https://www.vodacom.co.za/vodacom/terms/contract-cover-terms-and-conditions. To cancel SMS CONCOVOFF to 30150 or call 082 135 I am on a uchoose Flexi account which has a flat rate every month and was not informed prior of this unilateral decision to deduct additional money off my account for life cover, why on earth would I want such expensive cover! Why should I be told to choose to cancel the deduction, I should be asked if I want the cover In the first place. This goes against the consumer protection act, totally *******.

This response is not good enough. What gave you the right to unilaterally decide to deduct this cover without consulting with me first! Sending an SMS stating that it is up to me to advise you if I didn't want this cover is not consultation. Refer to right 3 of the consumer protection act the right to choose and right 5 the right to protection against negative option marketing "suppliers are no permitted to promote any goods or services or automatically enter consumers into agreements for the supply of goods or services. I.e. if consumers receive unwanted or unsolicited goods or services they are under no obligation to pay for these goods or services".
As per my email to your consultant, send me the details of where I agreed to allow you to just go ahead and deduct money for services or policies that I knew nothing about?????

I have no choice but to report this issue to the Consumer Goods and Services Ombud as I have yet to receive written notification as to where it states in my contract that you may use negative option marketing. As I discussed with your consultant, how many other clients like myself normally disregard your sms's due the majority being spam. As a result how many of them failed to read the SMS and thus have had this policy forced upon them? Yes I know you have reversed the cover for me, but you have not given me ANY feedback about how you can legally justify the way you enforced the cover in the first place.

I have tried resolving this issue via the call centre (yes Vodacom have tried contacting me but I work and have been in meetings when they called) to no avail. All they tell me is the cover has been cancelled, that is not my issue WHAT GAVE THEM THE RIGHT TO UNILATERALLY ADD THE COVER WITHOUT MY CONSENT. I've wasted so much time trying to resolve this issue directly with Vodacom but to no avail, hopefully the ombudsman of goods and services will obtain a relevant reasoning to the negative marketing option app****.

This issue has happened once again. An SMS sent 28 February stating "an enhancement to clip and contract cover for R 15 pm. To opt-out SMS CONCOVOFF". Once again this is negative marketing that goes against right 5 of the Consumer Protection Act. I was assured that this would not happen again after my complaint lady year!
