Failed to notify within prescribed period to notify customer
I went to a Vodacom shop and informed them that my contract would be expiring on December 5.. They immediately (without listening to my request), passed the buck by telling me they cannot help me and that I should phone customer care. After speaking to the manager, he advised me that I have to phone Vodacom EXACTLY 30 days before my contract ends, to inform them about my intent to cancel the contract and convert to prepaid. I explained to them that I will not be in the country and that I would not be able to phone on that date. They then informed my that I can get someone else to call and pretend to be me! I then called Vodacom customer care seeking some additional help, but was told the exact same thing.
This leaves 2 questions. Hoe compliant is Vodacom when it comes to South African Law? Section 14(2)(c) of the Consumer Protection Act 68 of 2008 clearly states that service providers need to provide you with 40–80 business days’ written notice or “any other recordable form” of the fact that your cell phone contract is coming to an end. This has not been done. What about Section 14(2)(b)(bb) that states you can give your service provider 20 (twenty) business days written notice to this effect ?
I tried calling again this morning, and once again I spoke to a person that can hardly speak, leave alone understand english.
I'm wondering if Vodacom has ever sent anyone a notice that the contract is coming to an end?
