Dispute of Alleged Debt –Zandalee Smith
Subject: Dispute of Alleged Debt –Zandalee Smith
I am writing in response to your attempts to collect a debt from the estate of my late daughter, Zandalee, who passed away on 28 November 2020.
This matter was resolved directly with Vodacom in December 2020, who confirmed in writing that the accounts were closed with immediate effect and no claim would be made against the estate.
As there is no valid debt, and no estate was formally opened (based on legal advice), I request that you cease all collection activity. Continued harassment will be reported to the National Credit Regulator (NCR) and the Consumer Protection Office, as well as considered a violation of the Debt Collectors Act.
Please confirm in writing that you have closed this file.
My son Julian John Smith has now been blacklisted for an amount of +- R3000 because Zandalee gave his name and surname as a reference. Julian was not aware of this and now he is being sued by VODACOM and DEBT COLLECTORS
- Debt collectors may not harass or misrepresent the legal status of a debt.
- You are not liable for your adult child’s debts unless you co-signed something — which doesn’t sound like the case here.
- The Consumer Protection Act, Debt Collectors Act, and NCR all give you power to lodge formal complaints if needed.
