data bundles

I have a contract for a phone which my brother uses, he should not be able to purchase data bundles on a top up contract. This was not agreed upon when the contract was taken out. I am the contract holder and should have signed for this feature. This means anyone who *****s someone's phone can buy data running up the contract holders account.
