Contradiction of the Consumer Act
Vodashop Summerstrand
My 69 year old mother, Junita van Dijk, went to Vodacom Summerstrand Shop yesterday late afternoon (28 June 2021) to cancel her contract. She hastily agreed to an upgrade presented to her. The shop assistant assisted her with the contract and opened the phone. She did not receive a copy of the contract. Upon returning home, she immediately realised that she had made a mistake and can not afford the package offered. I took her to the shop this morning (29 June) to cancel the contract as she has a right as per the Consumer Act of a cooling off period of 5 working days. Unfortunately the supervisor at the branch was very unhelpful and rude. She stated that their policy does not take the Act into consideration and she will be locked into this 24 month contract despite the protection that the Consumer Act offers her. I did call the call centre and was assisted by a very helpful member. She unfortunately was not able to assist and said we had to go back to the store to ask where we could lodge our complaint. This is of course not possible as they were unwilling to assist in the first place.
Please could you provide a reason and solution to this indifference and blatant contravention of the right offered to South African consumers.
