CONTRACT DISPUTE

I have received a package of my order contract from Vodacom Sales departmentas it was delivered by RAM courier yesterday 22 November 2017.

I have noticed the following after activation: The serial number of the SIM-Card in question is: ********** ********** 672352

The data displayed on my balance query is 1.43GB which expire in 01/2018 and the 1.50GB Night Owl. This is not what I was expecting following the discussion I had with the consultant when the contract was sold to me. According to our conversation only the premium was going to be pro-rated and I specifically asked the "lady" about this issue regarding the possibility of the same pro-rata on the data but her answer was no "Data is not pro-rated". I was made to believe that I sign-up for a contract of 5GB anytime and 5GB Night Owl and my expectation was that when I check the balance it must reflect the same - nothing different. And as to the pro-rata I was made to believe that only the premium is subjected to that not data and I found it not to be the same. To me it sounds like I was misled in the process and I will not want to accept that I be misled in this fashion. What more was I mislead with in this package??

These are the grounds of my inquiry and I request that you go on records of this sale and kindly after please provide me a copy there of so that I am in a possession of this since I want to dispute that what we agreed from the day I took the offer differ from what I have received.

In my attempt to find answers through ********** , I was told that there is nothing they can do by the lady I spoke to that is why I escalate this matter to this email. I hope that this matter will be dealt with and be given the priority it deserve. What I would like to bring to your attention is that the ********** are there to assist not to frustrate customers like they did to me when I called this morning.

Furthermore, I received the sms from vodacom which states that I will receive 250MB of data for 11 months. I need clarity as to what is going on here. Pretence If I do not get any feedback from you by the end of business day I will seek legal opinion on the basis of conclusion of a contract under false pretence or misleading because from where I stand there was no conscious on the current status quo. My conscious was on the facts discussed and a contract cannot be concluded if the latter is absent.

On the 23 November 2017 (Thursday), I spoke to one of the sales assistant manager who then promised me that he will investigate recorded conversation as per my claim and the matter will take three working days so I should expect the call from the investigating officer on Tuesday 28 November 2017. To my surprise, there was never a call from the investigating officer nor from the assistant manager as promised instead R141.70 was debited from my bank account. First of all it was not an agreement that they should debit on the said date except the 1st of every month. They have demonstrated that all that they care about is my money let alone the date of agreement. Secondly, they are not even taking this matter serious because they have not responded as they promised let alone the claim that this contract premised on the bases of misrepresentation. The assistant Manager never bothers to tell me why he is unable to respond on time. I made it clear that I am willing to give him a chance to go and listen to the recordings and once he is done he must release them for me because I am confident that the salesperson did not tell me the truth and I only consented to what we agreed upon. Anything other than that is not what I consented to. I believe that if Vodacom claim that the data they sent to me is pro-rated and they charged me the said amount for less than 5GB they promised but never delivered, how much did it cost me for the pro-rated data? I find it hard to believe their story if the contract I signed up for is R149 for 5GB Anytime and 5GB Night Owl and they charge me R141.70 for the 1.50GB Anytime and 1.50GB Night Owl they recharged me.

The company must give me satisfactory answer and from where I am sitting I have already lost trust in this relationship. I believe the contract has premised on the basis of lack of trust which emanated as a results of the other party and wish to invite the Hello Peter to assist me in terminating this contract because I can no longer trust that this will be a healthy relationship between the parties. Since this company is not treating me fairly neither is the sub-contractor under its brand.

I hope you will contact me and address this matter urgently.

At the time I write this message on my watch it was 13H11 and I have not received any call from Vodacom and I cannot say I am suprised if their reply was to create a picture that they respond quickly. Their quick response should be based on my complaint not that which is sent via Hello Peter but in this case their reaction is clear and is proven. Until and unless I have been contacted by the said consultant, please be informed that no action has taken place from Vodacom and I will notify you as soon as that happens. Now the time is 13H16
