Consumer Act Breach of Contract
Ours and other towns in the Overberg Area constantly struggle with no network coverage for the area, and for the past 6 months it has been an almost daily occurrence, 'Emergency Calls Only', or No Signal. There is absolutely no point in calling Vodacom because 1. There is no network coverage signal to call out from anyway. 2. When you do manage to call the call service centre, when the network has is actually working, they being somewhat challenged, don't seem to grasp or understand that it isn't just 1 number to test because an ENTIRE area has no coverage whatsoever. Correct and proper feedback on complaints aren't received, other than a general uninformative sms to say that a fault log is raised yet the problem/s persist. I continue to log a new 1* complaint to Vodacom complaints, every single time the network is down, until we residents in our area receive proper and subjective feedback as to why we more frequently than NOT, have no Vodacom coverage for which we have a contract for. Legally Vodacom are in breach of contract by not providing me with a reasonable service for which they ****** payment for by duress! I therefore consider that Vodacom is in breach of contract and as such, having changed my cell to MTN, have withheld payment as they have not provided me with a merchandisable product as per the contract. I await litigation.
