Complaint: Subscription to Playboy via Vodacom without any notification or permission

In mid July a pop up menu repeatedly appeared on my cell phone asking if I want to subscribe to Playboy; I at least twice pushed the CANCEL option on the pop up, but it kept appearing. At some point I pushed the NO option on the menu and got the following message from the number +***: “You have successfully subscribed to Playboy for FREE for 1 day thereafter R10.00 per day”. I did nothing in response to this message as: • The message said I was subscribed for FREE for the day. • There was no indication that ignoring the message would result in subscription. • There was no number or way to know who the message came from, and thus who to follow up with. Since the message of 12 July I have had no further information, notification, notice, warning, report or confirmation that I was subscribed to Playboy; and it was only when I received my itemised bill from Vodacom did I see that I have been subscribed to Playboy via Mobixone, from R10 per day from 13 July; the amount I have paid to date is R165. On 14 August I contacted Vodacom’s customer care service to lay a complaint. Vodacom has subsequent confirmed that “all 3rd party services have been blocked” and that I will be credited the amount paid. But I'm still really angry! I am sure that the behaviour undertaken by Vodacom in this complaint is *******, If ******* then I am willing to testify against Vodacom to ensure that resultant punishment in the form of a fine, apology and change to business practice to align with the law is secured. If this practice is legal, then I urge that the law be amended to protect consumers by ensuring that service providers like Vodacom be required to: 1. Get explicit and stated permission from a customer for any subscription to a service. 2. That any confirmation notification of a subscription include the contact details of the service provider and instructions on how to unsubscribe. 3. That any violation of this result in substantial fines.
