Breach of Contract - Wrongful Cancellation of a Contract
Number in question: ********** “Without prejudice of rights” On 12 July 2018, I contacted the cancellations department to request a premature cancellation and the settlement for one of my contract numbers, being ********** , the consultant Thabiso assisted me with my request and provided me with the necessary documentation to be completed. I subsequently e-mailed ********** on the same day being 12 July 2018 with the clear instructions to: “cancel my contract with Vodacom with cellular number: ********** . The other number ********** (MyGig 5 Promo@R259 24M Top-up) still remains in full force”. I provided Vodacom with all the documentation required – Invoice_Quote_1-1ESF-2164_1- ********** ********** – Signed, Proof of payment of settlement in the amount of R 8,520.64, Identity Document (as well as the marriage certificate). On 26 July 2018, I contacted Vodacom to enquire about the reference number I should use to make payment for the other number, still being active to my understanding, and was informed that both numbers have been cancelled. If I did not call, Vodacom would have simply blacklisted me as according to one of the representatives there is an amount outstanding on the number which I did not even cancelled in the first place. I am flabbergasted about the fact that despite my clear instructions Vodacom proceeded to cancel the other number WITHOUT MY CONSENT. Further I still had data on the number which I paid for. This to say the least is unacceptable and ********* to simply remove or cancel a contract without a client`s consent, therefore Vodacom breached my contract with them. I request, no I demand, an explanation why Vodacom thought it well to behave in such a manner. I have been a loyal payer and long client of Vodacom and no this? No representative even bothered to confirm cancellation. Further Vodacom now causes me a huge discomfort and dissatisfaction to attempt to resolve this and I have to be satisfied to wait 7 -14 working days for the account to be reactivated. And the only words coming from them is “sorry for the inconvenience.” Why should I stay with Vodacom if this is the type of service they are providing for their clients? Should this matter not be dealt with to my satisfaction I reserve my rights entirely to issue breach of contract as Vodacom, without my consent, cancelled a contract.
