BREACH OF CONTRACT

This is a copy of the e-mail I send to Vodacom on 26 December 2016:

I have five (5) contracts with Vodacom and have been a Vodacom customer for more than 18 years. NEVER, NEVER have I received such unsatisfactory, inferior and inadequate service from Vodacom than in the last 12 days to be exact.

1. On Friday, 16 December 2016, I app**** for a new contract (U Choose Smart XS) at Vodacom Hatfield (Sachar Mobile Group), Hatfield Plaza in Pretoria. This was close to closing time (12:00) and I was assisted by Bruce in order to transfer my prepaid number ( ********** ) to a U Choose Smart XS contract. Bruce also had to complete a SIM Swap. Bruce informed me that the SIM swap would be activated within two (2) hours and that the new contract would be activated within 24 hours. I left Vodacom Hatfield at 13:20.

2. On Saturday, 17 December 2016, I phoned Bruce at 10:00, as SIM swap had not been activated yet. Bruce said he would see to the matter immediately. The SIM Swap occurred at 16:00 on Saturday afternoon.

3. On Monday, 19 December 2016, I had to go to Vodacom Hatfield again. When I checked on the Vodacom App, NO Airtime, Data or SMS had been allocated to number 071 ********** . Bruce again helped me as the manager was not available. Bruce confirmed that the contract was active. Bruce asked Brian at the Vodacom Hatfield shop to send an email regarding the matter to the following email addresses: ISDLOG, ISD.C3D, Ebrahim and CC'd me as well.

Bruce explained that Vodacom moved to a new computer system and that the system was giving problems. THIS IS NOT MY PROBLEM!!

4. On 23 December 2016, I yet again had to go to Vodacom Hatfield because when I checked on the Vodacom App, NO Airtime, Data or SMS had been allocated to this number in spite of everything. This time I spoke with Ebrahim who apparently is the Regional Manager. This person was CC'd in the previous email, but had no knowledge of this matter. He said he would forward the matter to higher authority but could not CC me in the email, as apparently this was an internal company email.

According to Ebrahim Vodacom had moved to a new computer system and that the system was giving problems. THIS IS STILL NOT MY PROBLEM!!

5. On 24 December 2016, a stop order of R256.00 for Vodacom was deducted from my cheque account. According to the small print at the bottom of the VODACOM "Individual Contract Agreement" in my possession, this was supposed to be deducted from my account "within two (2) business days of signing a Top Up contract". I paid for a service that was not rendered.

6. Today is 26 December 2016, I have NO MINUTES, DATA OF SMS on the U ChooseSmart XS contract for number ********** .

7. Thanks to your company's incompetence, I have had to twice purchase recharge vouchers to ensure that I can use my phone. Refer to attached copies of said recharge vouchers.

8. I send an email on 26 December 2016 and received an automated response Thank you for your email. Your reference number is: 003S~SCR4. This is a system-generated email that requires your response in order to be processed. After that, a Customer Care agent will contact you within 24 hours.

9. It is now 48 hours later and Vodacom still has not contacted me. Not a phone call or email. The regional manager mentioned in par 3, send me evidence that he forwarded the problem within an hour of receiving the email in which I CC'd him.

10. It seems that Vodacom has become so "big" it does not care about its clients any more. The Airtime, Data and SMS that must be allocated to my number has to date, 2016/12/28 19:37 not been allocated.
