Breach of contract?

<p>I have 6 cellphone contracts - 3 with MTN and 3 with Vodacom. In February this year my wife's Vodacom contract became due for an upgrade and, as I've been doing for the past number of years, I went to Videotronic in Grahamstown to upgrade. I got a Samsung S6. All went well. As happens in many families with children on cellphone contracts, when I arrived home, there was the usual debate about who gets which phone. In the end my son got the new phone and my wife continued using my old phone (hers was ****** 2 months earlier). My son is due for an upgrade in September when another reshuffle will probably happen!</p> <p>In May my son dropped the phone and cracked the screen. Again, this has happened before and was resolved with no problems. The Samsung comes with one free screen replacement in the first 6 months of ownership. The previous time this happened (also on my wife's contact), it was resolved within 10 days. However, since handing the phone in for repairs on 17 May this year, I have not had any service on this contract that I have been paying religiously for several years now.</p> <p>First, Vodacom denied that the phone was theirs because the SIM used in it did not correlate with the contract. I went back to Videotronic. They apologised for not informing me that I had to put the SIM of the old phone relating to the contract into the new phone for activation. However, they assured me that it would not be a problem as they would send proof of the upgrade to Vodacom. I found this process strange but accepted it. The phone was again sent back for repairs. Two weeks later again, I received a phone call from Vodacom informing me that I had to go to Videotronic to complete an insurance claim form. Again, not the usual practice, but I comp****.</p> <p>Since then, I have been sent from pillar to post by either Vodacom or Videotronic. Videotronic then claimed that the screen replacement will be handled by Samsung directly. Still no joy.</p> <p>So, here I am after 3 months of paying for a rather expensive contract with no phone to show for it and my son being unable to communicate with me or anyone else.</p> <p>At was stage can I claim breach of contract and demand my money back as well as the cancellation of said contract?</p>
