Blatant lying and *****ulent contracting- next step - formal ICASA complaint

Vodacom and Elite Mobile have *****ulently tied me up in another 2 year contract that I explicitly instructed them I did not want to enter. I was called by an Elite Mobile agent on 22 August who blatantly **** to me. She told me that my Vodacom contract was old and outdated, and being cancelled by the end of the month. She said that I had to choose which continuation option I'd prefer, or my contract would expire and I would lose my cellular number and functionality. I expressly told her MULTIPLE times that I was due to upgrade my phone and contract in the next month or two, and that I did NOT want to be contracted to anything. She repeatedly reassured me that it would in no way affect my ability to upgrade.

Fast forward 2 months, and I'm not allowed to upgrade, as I'm now supposedly contracted for a fixed 2 year term till 2026. I never received or signed any contract at all. I have gone in to Vodacom stores and spent hours on the phone, finally getting through to someone to review and requested the phone recording - which I still have not received.

On review of the recordings, Elite Mobile phoned me and admitted that their conduct was below board and "non-compliant" and that they would reverse the contract as soon as I returned a speaker that they delivered as a "free gift". In the initial discussion, I declined this speaker, and the Elite Mobile ****/consultant insisted that it was a free gift, to say thank you for choosing the continuation option before cancellation of the contract. It was by no means linked to any contract - as I wasn't entering into one at all.

The speaker has subsequently been given away to my domestic lady, as I didn't want it in the first place.

In summary - Elite Mobile agrees that they were *****ulent and lying and falsely contracted me into a 2 year contract that I explicitly did NOT agree to, and now have taken 7 months, and still haven't resolved their issue.

My next step is an official ICASA complaint against Vodacom and Elite Mobile.
