Blacklisted for what?

<p> </p> <p>Totally disgusted by Vodacom, messing around with a perfect credit record becasuse of their own incompetence. </p> <p><br />A few years ago, my husband and I agreed to a data contract from you (agreed because the telemarketer on the phone did not stop). </p> <p> </p> <p><br />When the two years of the contract ran out, my husband paid every month until he cancelled it- he phoned Vodacom and cancelled, and since then the contract was cancelled. </p> <p><br />Just recently he received an sms from a firm- Hammond Pole Attorneys, which stated that his account has been handed over to the attorneys by Vodacom because he didn't pay his account - so his first thought was do I have to pay for something I cancelled? The sim isn't even working anymore, should I pay for this? </p> <p>So yesterday this said firm phoned him and told him that he is blacklisted now because he did not pay the cancellation fee? What cancellation fee? </p> <p> </p> <p>As far as I am concerned- if your contract has run its 24 months, which you paid religiously every month, and on a month to month basis until you cancel, there is no cancellation fee at all, this is also stated in the Consumer Protection Act 68 of 2008, which I'm sure you know by heart. </p> <p>Section 14 2(b) (i)(aa) : "the consumer may cancel that agreement- upon the expiry of its fixed term, WITHOUT penalty or charge, but subject to subsection 3(a)..."</p> <p>So now I am confused- it is in my rights to cancel a contract without any cancellation fees on its expiry, but Vodacom is going to blacklist me because I did not pay a cancellation fee which in the first place I do not have to, and which in the second place the lady at Vodacom who my husband spoke to over the phone(who cancelled the contract) did not even tell us about? Is it not the job of the employee of Vodacom to enlighten us about a cancellation fee BEFORE handing our account over to attorneys, or is it the consumer's responsibility to smell that we have to pay a cancellation fee? And why do we have to pay a cancellation fee? </p> <p> </p> <p>I know that if we cancel a contract when the fixed term has not been comp**** with, it is within Vodacom's rights to charge us a penalty fee, but our contract has expired- and now our perfect credit record is being messed around with because you didn't do your work properly. How is this fair at all? HOW? </p> <p><br />So in conclusion- my husband told the lady from the attorney's firm that he is not going to pay anything- that contract expired and we do not have to pay anything, she only said again that we are going to get blacklisted. He then said that she should please take him to court- because first of all, the contract expired and you have no rights as far as I am concerned to charge us anything for cancelling it as per the Consumer Protection Act, secondly if you do somehow- I am sure the recording of the call between my husband and your call centre agent will prove that no one told us about a cancellation fee which means that it isn't fair against any consumer to expect them to pay any fee which was not discussed or agreed upon. </p> <p> </p> <p><br />Please call this Hammond Pole attorneys and tell them to fix this situation and strike us from any of their future communication sooner than blinking an eye- because this is totally violating our rights as protected in the Consumer Protection Act. Hammond Pole should rather not phone us again and they should unblacklist us because they did not even check the facts properly before taking this action. </p> <p> </p> <p>This is so wrong on all the levels of our rights. </p> <p> </p> <p> </p>
