Unhappy rider

I took a ride with uber on the 28th november and left my phone I'm the car . I have since been in contact with the driver and uber .the driver admots to having my phone but still i do not have it back. WHAT is Uber going to do about the driver and what will UBER do about my phone ? I will report the driver to the police as he has ****** my phone
