Undelivered order

I ordered a meal an hour ago. I waited for a driver while tracking him. He stood for more than 5 minutes in a position 2 mins away from me. it kept on saying 2 mins away and the next moment my app said the food was "delivered". I contacted UberEats and they said they won't refund me as the driver waited outside for me, which is not true.
