UberEats Driver ****** Me On And Of My Lunch Break

I'm only giving it a 2 because of previous good moments but this one ruined the app , in total for me. Imagine this: You place an order before your lunch break. While your food's still being prepped, you get a message from the driver to confirm address. You confirm it 3 times (because there are 2 ways to get to your building, from the restaurant but want to make sure they use the one that doesn't confuse them). You confirm it 3 times.. They leave, and immediately take the opposite route. So they enter the premises that has many roads that could bring them to the entrance but also some that don't. You're waiting at the seventh floor entrance (because that's where you usually pick up from). They say they've arrived but are nowhere in sight. On top of this, they've turned off their location so you can't see if they're at the bottom entrance, on the other side of the building.. but you run there just in case.. you get there and there's no one there, you even peak around the corner and don't see them (all while texting them because they can't describe their surroundings).. So you run back up to the 7th floor (from ground floor) just incase they drove up there (the building is embedded into a ridge, for context) you get there, they're not there. They finally respond with "I'm under a building" which gives an idea of them having gone underneath a tunnel that extends beneath the building.. so you run back down to ground floor because they're in a section they're not meant to be in; but when you get there, there's not a car, bike or human in sight. You text them frantically and 2 mins later they tell you they're in level 4 parking but can't see you. (This is staff parking by the way, this means they've been driving around the block and found an entrance on the side). I run up there and don't see them, signal is on the frits because this is as good as being underground. A message comes through saying that they drove and turned right (whatever that means) but they finally call me to tell me they're now in the parking of the ground floor area, in front of the entrance. I tell them to wait there and stop moving around but they cut the call. I run back there and as i get to the door and am about to text, I get a notification to say my delivery was cancelled. no refund. I'm fuming at this point. I take it up with UberEats directly and explain the situation expecting a refund. This was their response: "Sorry to hear about your experience, but this order is not eligible for a refund.

We looked into this and can confirm that the delivery partner followed our policy. They tried to contact you through your phone number ending in ---- and also waited at your building premises for 20.

In what sick world do they define "waited at your building for 20 mins"? Waiting implies that you're in one spot. How does driving around a building, while someone is trying to find you on foot, constitute as "waiting"? I wasted my lunch time, my money and I was left hungrier than when I ordered the food. All because of the driver's incompetence. A whole platter of food paid for, that they get to enjoy on my lunchtime. It feels like I was ******. The person made it impossible for me to find them. In what world does a person chase a vehicle (on foot) and win? I'm considering taking legal action because this is grossly wrong. Even by their own logic of "waiting".
