Uber Eats driver *****s my food and gets away with it

I placed a large order and the driver never reached my home. My phone rang once and when I returned his call he didn't answer. My order reads delivered. He took a picture of my order at a location I can't trace and Uber Eats refuses to refund me because the driver had my phone ring once
