Refusing refund

So last night we decided to order Debonairs through Uber eats we waited longer than an hour for our food that never arrived. Went on to the app saw that it was delivered but we didn’t receive anything. Upon further investigation we saw that the food was delivered next door to us but the driver never made any communication attempts and when we tried to call him his phone went to voicemail. We also went to go look next door for the food nothing and now that we want a refund for food we never received that want to deny us. We live 15 minutes out of town and don’t have a car so we had to spend extra money to go get other food because their driver was *********** and they don’t want to take responsibility for it. We’ve ordered from Uber eats before with no problem but after this one I’m not so sure.
