Refuses to refund

My son bought a meal with a milk shake via the Uber app, milkshake was not deliver driver said he should lodge a complaint on the app, did that and their response was “ unfortunately we cannot refund you at the moment” why not??? We paid for the milkshake and never received it,,,, I WANT MY MONEY
