Paid in full but half order delivered

I ordered 2 can dine which consists of 4 pieces of chicken 2 small chips small pops ND 2 buddy drinks

I received 3 pieces of chicken ND no coldrink was given when I told the driver he said he is going home and can't go back to the store..... Lodged a complaint on Uber eats and they advised the order doesn't qualify for a refund so I'm supposed to pay in full for a order half delivered
