ORDER NOT RECEIVED!!!!REFUND ME

So Uber driver gets at the gate they call me I then go outside my house wait for this guy. I can see on the tracking app that he isn’t moving where he is he then calls me and tells me he’s outside, I told him no you’re not cause I’m outside and there’s no one there.he then hung up .tried calling him multiple times with no response, I then see him pulling up my street the next thing he makes a U-turn I call him again he ignores.5 seconds later I get notified that my order has been delivered. In my panicked mode I call this Caleb guy again and again he’s not picking up. I then drive to the gate to check if he didn’t deliver there to my surprise he just drove out no delivery was made there. I call him he then answers and says my food is at the gate. I asked him “which gate Caleb cause the one I’m at there’s no delivery there” he then hangs up. Never heard from him again. Uber eats your policy says I’m not eligible for a refund. Well I want my R239 back it’s my money that I worked hard for, it feels like you guys just made me buy your driver dinner cause clearly he took it. He wasn’t even in my estate for the time he claimed he was.
